hi i'm penny with evil sizer and associates today i'm going to do a training video on what is a boc this is the most asked question in our business and i'm going to answer all of your questions today [Music] so what is a boc let's get started i want to introduce myself i'm penny royston i'm owner of evil sizer and associates we have been around filing boc since 1991 but our company started in 1990. we have been doing this a very long time we're one of the oldest companies process agent companies in america we have filed well over 150 000 bocs and we just know the system we know how it works we know how to do the back end and so i'm going to explain the entire process from start to finish so i thought we would just start out with the regulation you can look this up on the 49 cfr part 366. and the rules in this part relating to the filing of designation of per persons upon whom court or agency like the usdot process may be served applies to interstate for hire motor carriers brokers and freight forwarders i want to emphasize interstate if you are intra state this does not apply to you right now so here's the form there is a form it's called the boc3 and boc my dad rex evil sizer said boc simply means bureau of compliance and it's form number three hence boc3 so this form boc3 is the form that we fill out and provide to our clients who hire us to be the process agent for the mc mx or freight forwarder number only one completed current form must be on file you cannot file to now this is different than your resident agent with the corporation that's a completely separate filing but as far as with the government with the fmcsa only one boc can be on file at a time so it must include all the states for which agent designation is required so here at evil sizer we cover the whole 48 states plus alaska and washington dc we have never needed a need for hawaii so we don't cover that one here we certainly could in the future if we see a need but in the last 30 years we have not so we just kind of leave that one alone and then one copy must be retained by the carrier broker or freight forwarder at its principal place of business so what we do is we file electronically and then we provide you with a copy so here's the boc3 form it's currently used to be just two pages now it is one two three four it is five pages long when you get a completed copy this will be completed it will have all of the agents that are have agreed to be our agent on our list that's been approved with the government and then we fill out your company name address and then the usdot number and once you get this from us you'll know it's been filed electronically so i don't know if you notice i'm going to go back up here you probably didn't see right up here this is another common question we get is what is this expiration date up here and so i enlarged it so you can see that does not mean your boc has expired this is simply a notation for us that we're using the current form the day we issue it so the expiration for the form design on this particular boc is january 31st 2023 it's really nothing you need to be concerned about but sometimes the government is concerned about it if they see that we're starting you know when we do a new agreement with the government uh let's say we change an agent and we have to provide them with a copy of a completed boc and if they see that this date is out of date then we have to redo it so we try to make sure that that date is current each time we file a boc so eligible persons who can be our agents you're going to see a whole list of states with different people's names or a company name or an attorney's name and you're gonna see their address you won't see their phone number or an email you're just gonna see an address so really to be our agent it's you have to live and reside in the state that you're representing that's basically it you don't have to be an attorney you don't have to be a permit office you just need uh to be a resident in that state and you're willing to accept documentation on your behalf so if a state official is designated evidence of his or her willingness to accept service of process must be furnished and we do that through an agreement we have a notarized agreement with all of our agents and it's all been approved on file with the government so another thing you want to think about is blanket coverage we provide blanket coverage now back in the day we would ask you what states are you traveling through and then we would only list those on the boc that you needed well now we just cover the whole gamut so you don't have to worry about this boc form whether it's compliant or not once we file this with the government it will be a blanket coverage and you'll notice later on i'm going to show you but once you see our name listed as blanket company that means we are your boc holder now i don't like that they use the word blanket company because sometimes people look there and think we're an insurance company and we're not and we'll talk about that a little in a little bit so blanket coverage is simply a third-party process agent company that's set up with the fmcsa with notarized agreements between us and each one of our state representatives and then we're set up to file the form electronically and this fulfills your requirement if you're a motor carrier an mx carrier or a freight forwarder or a broker but you're only going to have either an mx an mc or a freight forwarder number and then we provide you with a copy of the completed boc for your record now let's say you want to cancel your boc you can do that by just by simply hiring another company yes you're going to have to jump through hoops with the other company pay them a fee and go by whatever their terms of service is so this is made by the motor carrier broker or freight forwarder just simply by filing a new boc however where a motor carrier broker or freight forwarders dot number is inactive for at least a year we can go to the fmcsa and have our name removed boc removal a blanket agent may request a termination of the contract with the client if the terms of service have not been met this is reported within 30 days so this type of boc removal may jeopardize the status of your account causing it to go inactive so beware of that every blanket company creates their own rules there's not a set of rules listed anywhere the government does not tell us what we can or can't do so be sure you know what the terms of service uh are so here at evil sizer once you get served then our agents come into play there's a lot of stuff that goes on in the background and we do have a terms of service and if that is not met to our standard then we do go ahead with the proceeding and do a boc removal at that point you will hear from the government saying hey your your company that you hired no longer represents you to keep your account active you need to get a new one on right away so it's a good idea to check out the account with the government on a regular basis and of course with us this only means that you've been served if you've never been served as a defendant in a legal dispute then you don't have anything to worry about so some companies do charge annual fees we do not charge annual fees here it is not required with the government there's nothing that the government requires us to do on an annual basis so here we do not charge an annual fee we only charge you a fee and that's listed on our terms of service on our website if our agents are involved you know all of a sudden we've been served with documentation and we've got to get this to you and depending on what state it comes from depends you know on what uh the process is so just know some agencies do charge annual fees and they just kind of tack on other services there is nothing wrong with that that's just how they choose to do their business but here at evil sizer for you know we've been doing this over 30 years and we have just felt it is not necessary to charge a company who's doing all the right things so why charge a fee well the client is the defendant not the agent there's a lot of stuff going on behind the scenes that you don't realize that's going that's going on there's time involved serving the documents state agents often charge a fee and so they bill that back to us and then mailing of the documentation you know there's scanning there's time there's postage so there's a lot of factors in why that we charge a fee so how do we serve the papers let's say you're a defendant and we received papers on your behalf from whatever state it really doesn't matter so upon the receipt of the document we contact you in multiple ways first off we email you a copy through our tracked crm we can tell if you've opened that email or not and then we also we have this whole campaign lined up because we want to make sure we've dotted our eyes we've crossed our t's to get this document to you as soon as possible because you may need to hire an attorney to defend yourself we also mail it us mail and that's with a tracking number and we do go back and make sure that you received it sometimes we'll fax it uh we'll do any method possible to get it to you so what we are not and this is often a question is we are not the insurance agent even though we're listed on the l i the licensing and insurance form as your blanket company that does not mean that we are part owner we have no financial investment in you nor are we your insurance agent so sometimes the plaintiffs will come to us thinking that you know they want to file a claim and we just have to tell them we are only the messenger if this goes to court so again our role as your boc holder we accept legal documents on your behalf we're simply the messenger and we're the boc holder for either your mc mx or freight forwarder number so here is what you're going to see if you go to the l i and i'll put a link below so you can this is all public information so you can go to i just picked this one at random and so here is where you can tell if the boc has been filed or not so if you can see right here it says evil sizer process servers and i put an arrow that pointed right there and you'll see boc3 yes but then it says blanket company and this is where it gets confusing for some people looking on this system they automatically call me and they're like i need to file a claim and it's like wait so i can usually give them the policy number and a phone number to your insurance agent however we are not that company that you need to contact for claims so how much does a boc3 cost well it depends on who you're hiring it can go from twenty dollars all the way up to two thousand dollars now realize i've seen some companies out there that charge twenty 20 and they charge an annual fee so for what you think you're getting a good deal in the beginning they might be a new company and not really know what they're doing they're charging they're not charging enough for the service so they're going to come back around another year and then they're going to charge you again so these are things that i just want you to be aware of that i've seen in the industry in the last 30 years so here we really try to be transparent you know we charge 39 for each filing and you need to file if you're a new carrier if you file the name change an address change reinstatement transfer of authority or you simply want to change the agent to us that's totally fine you do not get penalized by the other company they won't even know so not a big deal so we'd love to have you as a client we'll take good care of you we take good care of all of our customers and just go to evilsizer.com and i now understand the entire process so be sure you hire a company that knows the process that you're not just getting a cheap rate and you could end up with a default judgment down the line if they reasoning was behind that i have no idea and they don't ever come and talk to us about it so we just found out and so we're investigating that but whether it's today or tomorrow you know it still gets
