on the Missouri Supreme Court website our website actually links to that so the information about you'll need to get going is the circuit court that you were convicted in for the charges you're trying to get expunged the case number that you were convicted in description of the charge of charges that you are wishing to have expunged the date you were convicted the county prosecutor that filed your case information about any state agency that may have record of your arrest or conviction and your driver's license number also remember that before filing or before filling this out you want to look at whether or not your offense qualifies for expungement do you remember noted this on the website that offenses that do not qualify are all Class A felonies any misdemeanor felony involving domestic abuse any dangerous felony any crime and requiring registration as a sex offender and any criminal offense with death as an element also remember we're filling this out that you can only expand up to two felonies and one sorry two misdemeanors in one's lifetime in one felony in one's lifetime so again two misdemeanors in one felony in one's lifetime so once you get all that information and you're ready to start looking at this form and filling it out you can start and remember you know when you're looking at whether or not you're crying qualifies for expungement and tracking all this information down this can be a pretty you know daunting process and having the experience of a criminal defense attorney helped you out it's definitely probably worth its weight in gold to have that in this process because you know you're talking about your criminal record and making sure that it's as pristine as possible is very important to you and probably worth the money to pay an attorney to help walk you through this process but nevertheless once you have all the information that you need you will begin filling this point out and we're gonna use an example today to walk through this form and we're going to say that me Chris Miller received a conviction possession misdemeanor drug possession in Boone County Missouri and I received that on January 1 of 2015 okay so we know that Boone County is on the 13th Judicial Circuit there's a guide a link to a guide on our website for which counties are in which judicial circuits for our purposes today we've already done that we know that Boone County is in the 13th Judicial Circuit so what you'll do is you'll take this petition and you'll fill out 13th Judicial Circuit Boone County Missouri at the top so we'll look like this next what you'll do is you will write your name and as the petitioner so we'll say Chris Miller so right there where it says petitioner it will read Chris Miller next you're going to list all the defendants and those are the lists of all agencies that you believe to have your records of your conviction so we're going to add the circuit court and let's say that it's division 9 in Boone County you can also add a municipal division in there a city of Columbia for example if you had a misdemeanor drug conviction out of city of Columbia you can add them in there you'll want to add the Missouri State Highway Patrol because they will always have your criminal conviction you will have to add the prosecuting attorney we'll talk a little bit about why they have to be added there but B the county Boone you'll want to add the Missouri Department of Revenue in case they have any list of your conviction you also want to add the arresting agency in this case we'll say that we were arrested by the Boone County Sheriff's Department Bureau arrested by Columbia Police probably want to add Columbia Municipal you also want to be safe you can add the other agencies in there as well you may also think about adding and I'm not gonna worry about it for today's purposes but may want to think about adding than any other state agencies that you believe may have a list of the convective conviction if it pertains any licensing issues so for example Department of Conservation any hunting license issue you might want to have them attempt to have them remove the conviction if you believe that could to help you clean up so many some issues that may be preventing you from getting your hunting license that's an area with the new wall that attorneys are still trying to figure out but once you're all set and done top of your petition will now look like this we have the Circuit Court Division that we would like to have remove the Missouri State Highway Patrol the County Prosecutor Missouri Department review and the Boone County Sheriff's Department all right then you want to review and we'll talk a little bit about what the what you're swearing to here we'll talk a little bit about that here in a second once we get to the signature portion but you want to review that because you're making you're swimming under an oath that these things here are true so review that but we move on to the next portion of the petition which is full name will say Chris Miller asks for your gender and your race and your date of birth in your address and what she gets done it should look something like this but that's not my field birthdate or anything like that or my real driver's license number but you can kind of see how to fill us out it's nothing special but it does have some information there that you need to fill up next what you'll need to do is the next sheet is it's asking for information about the specific case so hopefully it's out real quickly so we said that I was a January 1 2015 conviction so we'll say that the case number was 14 ba - CR 0 0 0 0 0 that's not an actual place but court name will say is Boone County Boone County Circuit running out of room there say approximate date of charge again 1 1 of 2015 which allows us to comply with the 3-year requirement for a misdemeanor county municipality charge boom in description charge possession misdemeanor and then you will sign so now it looks something like this so once you review all that information again go back to and before signing like I just did go back to yeah the the contents of the petition that your your swearing by and you want to remember that your swearing are affirming that it has been seven years if the offense is a felony or at least three years of the offense is a misdemeanor since the conviction or that you've completed any authorized disposition under five five seven zero one one and what that means is if you were on a term of probation you would need to it would need to be three years since you have completed your probation [Music] additionally the the person has not been found guilty you give not found guilty of any other misdemeanor felony since that conviction that you've satisfied all obligations relating to the disposition so you don't have to pay any other fines a restitution there are no other charges pending the petitioners habits and conduct demonstrate that the petitioner is not a threat to public safety of the state and that the expungement is consistent with the public welfare in the interest of Justice Warren theack sponge right that last part courts always gonna have to make a finding of that in in it is possible that they you could you know go through this and the court finds that for whatever reason a expungement is not consistent with public welfare fair and or the interest of justice do not warrant the expungement and that last requirement is probably also why you maybe want to talk to a an experienced criminal trial lawyer who can walk you through this process and make sure that you're setting yourself up at the end of this to have a successful expungement the other thing to really keep in mind about this too is that the there are certain areas where you the expungement is not going to be as beneficial as you might have thought the the expungement acts as a seal a court seal and may still come up on background checks and the way that they'll come up is if you're filling out an application or you're going through a certification process and there there may be times where the conviction needs to be disclosed some of the areas to watch out for when applying for jobs and getting certifications is if you're applying in the areas of emergency service providers law enforcement agencies banks or credit unions the insurance industry in any job where the employer is required to exclude applicants with criminal convictions from employment due to federal or state law those are areas where the conviction is probably still going to come up and you're still going to need to disclose the conviction but if you're applying for a job outside those areas the records will be under seal and you would not disclose also you know an example of that and you may be scratching your head about you know when exactly that would apply and you know the easiest scenario that I can come up with is if you're an attorney where you're in law school and you were going through the certification process that we called the character and fitness portion of the Missouri bar exam you would have to disclose the expungement for your character and fitness if you were trying to obtain the hey Missouri Bar license other than that once you get done filling this out what you'll do is you'll contact the Kord the local circuit clerk you'll have to pay a $250 fee in addition to any other service and filing fees that the local circuit clerk has for you but they can help you understand you know when and how to file this thing the petition for expungement once you file it you'll have 30 the the local prosecuting attorney will have 30 days to file an objection with the court after 30 days the court will then hold a hearing to determine whether or not you're eligible and whether or not your expungement fits the criteria under law especially that you know the expungement is consistent with the public well fully previously talked about if you have
