little golf yesterday that we've been having some wonderful weather boy today is even a better day than yesterday the wind was a little bl blowing a little bit but went to the nancy lieberman golf tournament out at uh golly the hills of prestonwood i believe was the name of the golf course uh just a beautiful course beautiful day nancy lieberman has a great foundation that she's you doing helping children uh with various activities underprivileged children annika sorenstrom was there uh it was great uh to to meet her you know i had forgotten uh until started being until she started getting interviewed that annika was the woman player who played at the colonial all those years ago i can't even remember when that was i remember being out there but i had forgotten totally that she she was the one that had done that i can remember all those old geezers over there at the colonial uh being outraged that they were gonna allow a woman play in the pga tournament it was great to see her tony dorsett was out there it was great to meet tony dorsett uh you know derek holland was out there got to meet derek holland it was uh all in all just a wonderful wonderful day a good good opportunity to meet some new people and play a little golf although my golf game suffered in the last few holes it was just getting windy though couldn't couldn't keep the ball straight for some reason maybe it's called lack of talent i don't know any event it was a great great time kvce sponsored me allowed me to be on their team uh had had a wonderful opportunity to meet some new people and money i know you took some of mine anyway that's wonderful well a lot's been happening over the last week um you know uh rick perry just uh the the th and i guess i'm just a legal nerd obviously i am i i practice law people a lot of people say i'm just a nerd no matter what but the bottom line is i love watching this rick perry uh maneuvers uh it's a very interesting procedural uh game going on right now uh between his army of lawyers uh gosh only knows how many he must have now i think there are a total of six and what's most interesting and curious about that is that only one of them if i'm not mistaken is a criminal lawyer the rest of them are all civil lawyers they don't do criminal work yet he has hired them he's hired everything from a former supreme court justice uh to to that being tom phillips to a very prominent trial attorney tony busby who is a fabulous trial attorney uh very capable very successful to represent him which is just rather ironic as i've talked about in the past that rick perry would hire a trial attorney to represent him in his most dire time of need and that just goes to show how important trial attorneys are in my estimation even the governor of the good state of texas in his most dire time of need has chosen a trial attorney to be his lead trial attorney on his trial team of six attorneys and he's not even a criminal lawyer so uh what's that tell you what's that tell you when you're in trouble when you really need somebody maybe a trial attorney be the first best way to turn and so keep that in mind folks but last monday was a hearing you if you recall perry got permission not to attend the hearing that was scheduled for yes two days ago and the reason was is that he had to have he had to be away because he was going to be in europe on uh promoting some business for the state of texas and so he got special permission that's very unusual uh from my criminal buddies they all tell me that anytime you have a hearing no matter what the hearing is the defendant must be there and the prosecutor must lay eyes on them it's kind of a way to be sure they hadn't left the state i guess uh or they're skipping bail but uh nonetheless perry got permission on this particular occasion not to be present and the judge judge richardson bert richardson said uh if i recall correctly that this would be done on a case-by-case basis but under no circumstances would rick perry be allowed to be absent from a hearing if substantive issues were going to be discussed uh or rulings were going to be made he absolutely has to be there and so uh he got permission for the first one and it's it's really striking it to me i've made this comment before how jerry jones and rick perry get caught up in the legal system and they're already asking for special favors they already want to go you know if this happened to you or to me uh you wouldn't get these special favors he wouldn't even think to ask for him yet because they're a governor because they own the cowboys they think they get these special kind of treatment or favors and hats off to the judge both in the jerry jones case and judge burke richardson in the rick perry case for for not allowing that to happen uh you know both of those judges have made comments that no the the system is the system and you will abide by the system and its rules and of course an exception was made for the governor since he already had a long uh standing commitment to go to europe but the next hearing that's coming up is on uh ironically it may maybe more appropriately halloween and uh there's going to be a hearing at that point in time that from what i understand from the testimony or from the hearing itself there's going to be two issues taken up on october 31st and here the perry matter and one of them is going to be whether or not michael mccrum the prosecutor who got the indictments because the if you recall perry's now been indicted on on two counts in essence of uh improperly executing coercion in other words uh executing uh his power to veto it's not the fact that he vetoed it's the fact that he was trying to blackmail the d.a into resigning uh if if he was going to veto her budget for the public integrity unit her public ethics unit if she did not and so after she refused to resign uh he went ahead and vetoed it but it's what he did afterwards but be that as it may the hearing coming up on friday they're trying to say that michael mccrum that prosecutor that got the indictments against perry was never properly sworn in so they are pulling out all the stops they're trying to beat this on a hyper technical issue which they're certainly entitled to do many things in the law are hyper technical and and you can win on a technicality but they are trying to say that both two things that the rosemary lindbergh's office the d.a for travis county did not properly recuse themselves from the perry matter and that michael mccrum never formally took the oath of office and fathered direct her correct papers they had a little bit of discussion about that at the hearing on monday and judge richardson felt very confident that the filings had been made but he was going to rule on this and hear more evidence on the 31st the second thing that he's going to be ruling on or at least hear evidence about is that the defendants rick perry wants his lawyers want copies of the grand jury testimony and that's very very unusual uh my criminal friends criminal friends and criminal attorney friends tell me that that is very very rare that that ever happens only if that witness is going to come back and testify at trial do they get a copy of the transcript of what they said in the grand jury proceedings because those are very secretive i suspect there's another reason they want this earlier early reports and the rumor on the street in austin is is that two very high ranking staffers were used by perry to approach lindbergh after he vetoed the budget to try to cut a deal with her and that's it's blackmailed her on the eve of vetoing that budget and shortly thereafter in fact there's a story out that he actually offered her a different job at a higher paying rate if she would just resign and from what i understand and the the word on the street is that these staffers testified 100 percent truthfully and it's not very pretty for rick perry and that's probably more the reason why they want to to get to this than than anything else so uh you know halloween will be a kind of an interesting time to see uh how that's ruled but the thing is is that rick perry's got to be there uh he'll be dressed as a defendant i guess on halloween and uh he will have to show up and be present stick around we'll be right back i'm going to catch you up on a that's uh in legal trouble as you know jerry jones is too how about them cowboys by the way but jerry's got some other things on his mind or at least he's going to tomorrow i wish the hearing was today so i could report on it but tomorrow jerry jones is having a real big hearing on his case unlike criminal court i don't think jerry has he he probably won't be at that hearing he doesn't have to show up but the uh his legal team is filing a motion to dismiss has filed and from what i understand i didn't get a chance to double check the docket sheet today before i left the office but uh it was set and i assume it still is set for hearing tomorrow and the primary issue in this is that the defendants are asking that the case against jerry jones be completely dismissed that it be thrown out of court and they are claiming that there is no basis in law or in fact that would support this cause of action and they they make that assertion or that allegation primarily because they claim that the statue of limitations has run and if you listen to to my ramblings at all you know that that is the big issue in this case uh under texas law the young woman miss weckerly had five years from the date of the alleged uh sexual assault to bring a cause of action and she claims that assault happened in june or july i believe maybe may or june of 2009 and she did not file suit until about five years and 121 days after the alleged assault and so the plaintiffs miss weckerly is claiming that she doesn't have to follow the statute of limitations because there's also a provision under texas law that says if you're suing an individual and that individual is absent from the state the statute of limitation is extended by each day they're away from this the estate so if they can demonstrate that jerry jones was gone from the state for more than 121 days over a five-day five-year period then they're excused and they they actually can file that lawsuit later and so it's going to be pretty interesting to see what happens on that issue and how the judge rules on that ultimately you know there's no question in my mind that jerry jones has been absent from this state for more than 121 or something days over the last five years excuse me i would think that between all the super bowl and football and nfl besides all the other businesses he has going on he's clearly been out of the state for that period of time so uh that's that's going to be it very interesting to see how it all shakes out it's also going to be interesting from a pure legal standpoint to see this motion to dismiss be ruled on because that is a brand new creature under texas law uh it was established in the 2011 legislature and uh until that point in time texas had never had a straight motion to dismiss uh type uh pleading and uh it has been very very rarely used because it is mandatory attorneys fees for the loser and most parties don't want to get in into that and so you don't see it being used very often and just as a hockey or misa hockey it's a legal junkie it's going to be kind of interesting see how the judge rules both on the legal issues and on the motion and on the award of the attorney's fees well what else has been going on in dallas can anybody think of anything besides cowboys hockey and uh jerry jones and rick perry well uh i guess we've had a little ebola problems going on and uh as i spoke to you last week there's a lot of legal ramifications to this not to mention obviously the public health issues that are permeating and everybody's talking about it the buzz about that but there's a lot of a lot of civil legal issues that that come out of this you know uh just to kind of bring you back up to date i know everybody knows this you know thomas duncan uh regrettably or unfortunately passed away last wednesday uh he is the only ebola victim who or a person who has been treated for ebola who has not survived in the united states if they've been treated in the united states they have survived he's the only one that hasn't you know he came to this country from liberia he presented at the hospital they turned him away uh notwithstanding the fact that he exhibited many of the symptoms of ebola and the fact that he just got transferred over here from or had arrived from liberia uh presbyterian hospital turned him away and there's a lot of questions as to whether or not the fact he didn't have health insurance played a part or a role in their decision making process he comes back two days later and he is in terrible shape apparently and the questions are really going to be could he have survived had they initially taken him in uh we are now learning that they waited six days six days even when he became admitted to use experimental treatment and we're finding out a whole bunch of other things about that and the fact that two other nurses have now come down with it stick around i want to talk about who's responsible from a civil liability standpoint the stuff that's going on over at presbyterian hospital here in dallas and you talk about three stooges i i cannot believe i sat here last week thinking there is no way that you could prove under texas law uh the the elements necessary to hold that hospital accountable and responsible for the things that have been going on because you hacks actually have to show that is willful and wanton that they knew of the high degree of risk they were subject subjecting people to yet they just basically willfully and wantly ignored that and subjected people to this risk anyway however what a week a difference makes um i am just about turned around on this now the the conduct of the hospital over there has been absolutely deplorable in my opinion uh they ought to be and i'm sure they are absolutely ashamed of themselves uh as i mentioned before the break thomas duncan the first ebola patient here in the united states to die uh while five others have survived he died there's been questions of whether or not because he was from liberia whether or not is because he did not have insurance that he was not treated appropriately or he is turned away and you would think it first blush oh please tell me that's not possible that that just couldn't happen but now we're waiting we're learning that when he came back to the hospital two days later they kept him and they did not immediately isolate him they kept him for a few hours in a non-isolated area of the hospital where seven other patients were exposed to him he was already exhibiting a high degree of symptoms for ebola we are also learning now that it took them six days to start using the experimental drugs that have saved the other five people's lives we are now learning that uh of course we know as of sunday that the nurse nina pham has now been diagnosed with it a a young nurse who graduated from tcu working at presbyterian and now we know that a another young young woman a nurse amber vinson has also been diagnosed with it both of these nurses were had high degrees of contact uh with mr duncan and you know the first thing that the cdc and the in the hospital say when nina pham was diagnosed oh she must have breached protocol it must be her fault that she was exposed to this because she didn't follow protocol now you know i've been doing this a long time and i immediately was appalled that they would somehow turn on her and blame her for being infected well now we're learning that well maybe maybe it wasn't her guys yesterday the nurses union comes out and says that presbyterian has constantly changing guidelines they had no protocols in place uh that the nurse supervisor who was insisting that duncan be isolated immediately upon his arrival at presbyterian hospital was rebuffed by management at the hospital that it took several hours to get him isolated that once they got him isolated they did not have the appropriate uh protocols in place to for for for gear or gowns and gloves they were treating with when they should have been basically in hazmat suits i heard a story yesterday that uh even though they were wearing the hazmats or the gowns they weren't wearing anything for their shoes they were just wearing their normal shoes so you have a patient who is gravely ill has vomiting and diarrhea that they call explosive i can only imagine i don't even want to imagine what that must be like they're sending these young nurses with no training no experience ill properly uh equipped to go in and treat this guy and then we find out that they don't even have a mechanism to destroy the gowns and equipment that's coming off that they say that it has been piled up to the ceilings in that hospital are you kidding me i this this is this is appalling uh you know the the laws in the state of texas changed back in 2003 to protect hospitals and of course the argument was that if you change the laws if you protect doctors and hospitals or any profession if you if you pr tect uh uh electricians like my hard-working father if you don't if you don't hold them accountable if they can't be held accountable in the court system then what motive do they have to do right all you say that you know a hospital would never do that i played golf yesterday with with a with a guy and we were talking about all of this and he says you know brad you you just think differently than i do because i i could never imagine that the hospital would would not have protocols or would breach protocols or or unnecessarily expose their nurses and people i mean they they got a moral obligation and it was before i learned all of this i just repeat just told you about the lack of protocols and i told him i said i called me a cynic yes i am but i've been doing this long enough i suspect we're gonna see and lo and behold not 24 hours later where we're seeing all of this and and mark if you're listening i i hope that you've seen all this and may make got you to kind of scratch your head and rethink some things i i just cannot believe it but you know so who's responsible here for uh nina bombs and amber's medical care you know if fortunately workers compensation is in place and uh fortunately or unfortunately if you've ever been through the workers compensation system you know how broke that is and how it is uh a pitiful pitiful uh substitute for the type of medical care that you truly need when you've been injured on the job like another another victim of tort reform but so you've got some medical care will they pay for the for the experimental drugs you know things have gotten so bad over presbyterian they have taken amber vinson and have flown her uh to emory hospital in atlanta to treat her i i think there's probably been a total and complete breakdown of confidence and trust and presby presbyterian's ability to handle this in fact they have demonstrated i don't know why they're not getting uh nina pham uh out of here and get her somewhere where hopefully they can save her life because uh i'm not confident that presbyterian could do it i'm not confident that at all but you know what what about all of their belongings have you have you seen the hazmat guys going into her apartment they went into duncan's apartment and they essentially take every piece of furniture every piece of clothing everything in the apartment they load them up into those big drums hazmat drums and they destroy it who's responsible for that i mean but for presbyterians total and all just lack of behavior of protecting their employees these young ladies probably wouldn't have been exposed to that yet they're losing everything they own who pays for that i guarantee they don't have a civil action against their employer for that tort reform is made very very sure of that these young ladies don't have anything they don't have a single piece of clothing left this the the behavior of the hospital and and the the things they have exposed their employees and the public to uh is is incomprehensible it is absolutely it's in my opinion criminal and for thus not to have civil rights uh remedies available against hospitals like this we ought to all re-evaluate it this doesn't make you wake up about tort reform i don't know what will your rights have been taken away and they just keep getting taken away because you don't do anything about it i'm up online and do that well we were talking about the ebola deal and uh you know the the ramifications uh maybe this all would have happened uh notwithstanding presbyterians absolute dropping the ball despite moe larry and curly over there not having any kind of protocols in place despite their not treating mr duncan appropriately timely or in a prudent medical fashion despite they're not even taking care of their nurses despite their not having protocols equipment despite subjecting them to all the the things that they have maybe none of this would happen but the ramifications now are just uh you know going crazy uh i i and we can't hold them responsible you can't hold them civilly responsible under texas law that's what's so mind-boggling to me uh you know the the politicians have uh lied to the public about uh tort reform the need to throw you know uh the lawsuits out and all the frivolous lawsuits uh out well folks you know the the part the soul of the matter is is that uh what what has happened is the legitimate lawsuits have been thrown out and it's going to take a lot of work a lot of time and until the public at large reacts to the inability to be able to seek civil redress for the absolute incompetence and stupidity uh and the harm caused by that stupidity and incompetence uh it's it's you know there's nothing we can do especially in this situation speaking of incompetence and stupidity the preliminary report on that truck wreck up in oklahoma came out uh coming uh reconstruction if you will you may recall the four young ladies who were killed on a bus that was returning from a softball tournament uh they were coming back and an 18-wheeler was headed north uh for whatever reason he missed a curve went over the median on i-35 up in oklahoma careened into the southbound lanes and hit this bus and killed four young beautiful women in the prime of their lives well the department of transportation came out today with their preliminary report like today or yesterday and they basically all they said was 72 74 miles an hour it's how fast that truck was going when it left the roadway uh there's already been a lawsuit filed here in tarrant county fort worth on behalf of one of the survivors of that and then hats off to them for reacting quickly and promptly they needed to get legal counsel immediately there's so many things that go on in these truck wreck cases and it's so important to have an attorney early there's so much evidence these aren't these aren't car wreck cases these aren't big correct cases these are a whole different kind of of the case uh you know we handle a ton of these things and there's so much evidence you've got the in essence the black boxes you've got the driver's logs you've got many things that are evidentiary that are maintained on the interior of the truck and oftentimes it is just amazing to me how many times we have a trucking accident case and the defense tries to hide the evidence through mumbo jumbo privileges and and the way the timing uh they they claim i got some the other day on a horrific truck accident that they said no we knew we were going to get sued the second the accident happened so everything that we gathered is considered investigative privilege and therefore we don't have to produce it to you that's the kind of approach they take and even in these cases where it's clear uh that where the wrong was and it's not on the bus driver it's on those truck driver that went 74 miles an hour out of his lane and crossed over into the other lane that's where the negligence lies and that's where the evidence is and that's where you've got to get to immediately and as time goes by uh some of those things disappear some of those things don't get preserved weird things happen if you're ever involved in a truck accident or any accident for that matter i mean but especially a trucking accident or you know someone it is you need to get them to an attorney a s a p so that that attorney can get his team of investigators his team of uh experts together and rounded up to start investigating start preserving the evidence start reconstructing the accident how it happened to try to find the reasons because i assure you these trucking companies do every single thing in their power to avoid responsibility and that's why it's so important and and not only that but you need an attorney like the parker law firm or someone like us board certified and personal injury trial law make sure that they have handled trucking accidents uh in the past it's not just every attorney that
