have it so and the lead landlord needs to initiate reasonable corrective measures within 10 days and remedy it within 30 so if you get notice of a leaky roof you got ten days to get off your butt and start and you got 30 days to have it done I think that's plenty of time so let's talk about reality here how many landlords do you think go I have that much time and they take it a lot so how think about what a turnover costs if you treat your tenants like you're only worth me taking the maximum amount of time you're not going to want to stay with you they're not going to want to renew here's here's my opinion so after you meet the tenant and you agree on the rent and they move in and you've had that personal interaction for a while chances are you're not going out and knocking on their door and getting rent they're either going to directly deposit it in your bank account either like from their desktop or walk into your bank and just deposit slip and pay or they're going to come in to your office if you have one or mail but you really after that initial time you don't have much of an interaction it's just yours check here's a check that's all they know like they have a place to live and they keep giving you money and what's like at that point if they're paying you were paying someone else it's all the same like they're just paying that money when they need you is when you make the difference so if they call you at 2:00 in the morning this is your chance to shine like this is like show time if that tenant calls you in the middle of the night do you think that they're electricity can you see that is this too small depends on the eye strength of the student all right so I don't think I can make this any bigger so this is the tenant right to early termination so as a landlord you'll become familiar with this list because people who want to break their lease in the middle will try thei best to fit into these scenarios a fake letter from a fictitious employer who is having them move 30 miles away so they can leave with 30 days notice if the tenants employment with their present employer requires a change in excess of 30 miles a serious illness of a member of the tenants immediate family so you look at this list and just know that they're going to read to listen if they want they're gonna try it so you just need to try to make sure it's legit landlords remedies for failure to pay rent all right so how many people here are familiar with the process if a tenant doesn't pay does anybody know all right Wow here I haven't had that problem yet lucky you have to get but I'm going to have you're gonna laugh yes so they do get a letter so it's called a five-day letter and here's where there's confusion so a five-day letter is a letter you send out after the due date and it says you have five days to pay or else that gets confused with on the fifth day after rent is due there's a late fee so somehow those get kind of joined together and people think that you wait five days until they're late and then you send a five-day letter telling them that they have a late fee because they're five days late no no so and what happens if you don't get this letter right and then you try to take them to court the judge goes what does that start over so they relate you relate they relate with their rent and then you sent them a letter and then they didn't pay and then you filed in court to get a court date and then the court dates let's say you're lucky and it's a month out and then you get to court and you're scared to be because it's your first time and the judge goes what does that start over if you learn I don't know man you think I already just lost all this time and now I'm going to double it so this stuff here is important so anytime after rent is due the next day you can send them a letter that says your rent was supposed to be this much and paid by this day you haven't paid pay up immediately or else and I'm not telling you what to write I'm just telling you the gist of the letter then you can send them another letter that says you have a late fee now you need to pay that you could wait until the late feet kicks in and then send them one letter that says you have five days to pay up oh and you also owe the lady and get your math right because the judge looked at I go these numbers don't work or you say but you confuse this poor tenant so bad they don't know what to pay does that matter calories versus business age yes it's business days I think it's business days for the first week and any timeframe over a week two calendar days I think but it's in like a it's in the code like I couldn't spend time to look it up it's pretty clearly I think it says time computations like in the index and explains it but it's like it goes from business days to Calgary's at sun cut off alright so let me see you can demand payment and notify the tenant in writing that unless payment is made within a time mentioned in such notice to be not less than five days after the date notice was given or since that's where the five day letter comes from the rest of agreement shall be terminated so that's what you're telling them you don't pay in five days we're done but you know it's terminated it's terminated that doesn't mean anything's like your judgment thank you you need to take it record and really get them out of there if the tenant remains in default the landlord may bring action for summary possession which is taking the court and whatever whatever other proper proceeding all right these are tenant obligations for the rental unit comply with whatever they're supposed to do for the city county state keep it clean and safe dispose of all Ash's rubbish and garbage keep all plumbing fixtures used by the tenant as clean and safe as their condition permits like would you think that that would be the case so what does that mean like in everyday terms your toilet is nasty like seriously that is gross you need to clean that used in a reasonable manner plumbing eating electric all that stuff don't willfully destroy two-face don't tamper with smoke detectors carbon monoxide detectors all that stuff so basic rules specifically go by it's a totally bad one final to add on to know what um so in essence you could take a cover sheet and staple it to the top of the code and those are the rules if you want to change the rules they're not upheld by the court oh go back to what happened oh so then you you go for summary possession so are you taking the court and the judge says oh yeah I see what's happening here Tennant you you owe this rent this is legitimate and the landlord is asking for possession possession granted so now the tenant has so many days to move out I'm thinking solution judge my view doesn't consume nas oh sure they might be that the tenant made a good case that they didn't understand or they cried or you know in JP court you're not talking like lawyers on the bench this could be some traffic cop that got the position or anybody like you want to apply apply so and then there's not like case laws or it gets just like there's the code and the judge goes okay I see I see you know this is what it says what they might be swayed sometimes I mean because we had almost 400 units right so you can imagine it was so funny like we would show up on landlord-tenant day you'd be like Ferris properties courtroom a all others courtroom B would be like everybody files in so depending on what judge you get like you're like yay or uh and it's the same stuff and one judge just might be a little more sympathetic or a little harder you just you don't know we used to try to in certain cases when we were really nervous about the security deposit amount especially in a large house with a lot of kids and you're going if there's like red juice all over this carpet that's going to be a lot of money so we're like how do we get enough security deposit if you're limited to one month's rent so we just thought thought thought and we say well there's nothing that says that the rent has to be a certain way like they can pay all twelve months up front why can't they pay instead of 1/12 the first month one six and then the second month and then like taper it down so that you're getting more money up front so that you could see how they're taking care of the house and if it's bad then you can start like hey you're not taking care of my place according to this code some judges were like no problem some judges were like you can't do that what plan the same room so and that's a believe is the duty of the landlord or or another tenant to repair shall be reported in writing by the tenant to the landlord as soon as practicable the tenant shall be responsible for any liability or injury resulting to the landlord as a result of the tenants failure to timely report such condition no consider in writing instances that's where I'm going with it so you open yourself up to the shall be prior to that of any creditor of the landlord including but not limited to bankruptcy so that money if you get in trouble can't be touched it's really just for that so that's like protection for the tenant all right so here's how the security deposit money gets allocated to reimburse the landlord for actual damages caused to the premises by the tenant which exceed normal wear and tear so if you need to paint is that normal you'd have a hard time saying it's not but sometimes it's way beyond normal wear and tear so your here's my recommendation when before they move in each phone video an application fee a landlord may charge an application fee not to exceed the greater of either 10% of the monthly rent for $50.00 so when you take a nap fee first of all don't feel like the 50 bucks is like too much or the 10% is too much people are used to paying that you don't have to be shy about it if you get a tenant report it could cost 50 bucks per person and this is this would be per person so if I have to pull credit and criminal reports and do background checks landlords whatever that's easily could be like the hard cost would be like 25 for the reports and then some time for somebody to work on it yeah so like yeah 18 or older because this is saying creditworthiness right um but it would behoove you to do criminal background checks even if it's on your own dime in certain cases and you just all right look if you've ever had somebody in your house and the kids are dealing drugs or the grandkids are living with grandma and dealing drugs man it is a nightmare sometimes and you know maybe you could prevent that by pulling the credit and your criminal report and seeing that the grandson has been arrested three times you know what I mean I mean I can tell you story after story about drug busts in our units it's it's a mess and when you get back on track and find a grandson that's three rest and you tell them sorry Mike aridity because of a background check you can be on a team I can't oh yeah yeah like it but here's the thing right so upfront you're like here's my business and here are the conditions in which we don't accept based on criminal history so in tenant to double the amount wrongfully withheld so you got to be on top of the funny things in economics and I kind of say well you have 20 days to get that to them but if it exceeds it then they were as a citizen where was it double the amount wrongfully withheld so you not if you weren't wrongfully withholding it a little bit process right so then in that case you weren't wrongfully withholding it then you need to get a judgment to get it but there's there's nothing like according to this there's nothing that you wrongfully withheld in creating a budget for each other in the last they talkin about that kind of thing good but here's I wouldn't I wouldn't mess around with it I would send them a letter and say your balance is zero because if there ends up being a time where you need to go to court you know what if they're not moving out or whatever if they want to see you for something you just don't want that to be part of their argument he doesn't do things well keeping even tell me
