In-state tuition qualification is granted to any student when the person that pays the tuition (yourself or your parents) pays taxes to the state where the university is located. So if your parents work in Florida and they pay taxes there, you could qualify to any university for in-state tuition, not just the public ones.This qualification is different from becoming a resident of the state. First, Harvard University is a Private College. No Private college (that I am aware of) gives a "tuition-discount" to in-state residents.    Some private colleges will provide a scholarship to a local resident, etc. but the cost is always the same whether the student is a resident of the state, a citizen of the USA, or an international student.Where your question has relevancy is, for example, if you are a an US citizen living in France, and you gain admission to UCLA (a Public college) in California.   You may be a citizen (or permanent resident) of the USA, but you are Not a resident of California for purposes of in-state tuition and fees.Public colleges will charge the Same amount for Room and Board to all students (typically).  However, almost all Public US colleges will provide a discount for tuition and fees to Residents of that state.   Typically, since your parents are expected to provide some level of monetary support for you while you are in college (under the age of 25), and it is the state of residence of your Parents that counts.    That is because the cost of the Public college (overall) is subsidized and/or supported by the state's tax payers.  Those are the Residents of the state.    Thus the college does Not charge more for out-of-state students, but charges Less for in-state students.As a resident of France (in the example, above) you are Not considered a resident of California.However, if your parents are working for the US government, and were residents of CA before relocating to France (in the example) for their job, then you typically would be considered a resident of CA.   Indeed, in that scenario, your parents would probably be paying CA state income tax or at least property tax on any real estate owned in your state of residence.BUT, if your parents are foreign citizens, and you were born in the USA when they were students or working here, and then they completely relocated back to their home country, you are an US citizen by birth, and can have an US passport, But you are Not a resident of any US state and typically can Not get in-state tuition/fees.However, on a state by state basis, you Must check the local laws on residency for college students.   Each state has a different definition.For example, in some states if You are self-sufficient and move to that state and live there for at least one year (before starting college), you will be considered a resident of that state and can get in-state tuition and fees.    But the Proof will be up to you.
