It was formerly part of Virginia, and was admitted as a state in 1863, in the middle of the Civil War. The government of Virginia at the time was part of the Confederacy and would hardly have consented to part of its territory joining the Union as a new state.But as it turns out, that was not the real government of Virginia. The legal justification for West Virginia’s secession was that as Virginia was seceding in 1861, the officers of the state who ran the secessionist government became illegitimate. People in the western part of the state started a new legislature called the Wheeling Convention, and this became the “Reorganized Government” of the state of Virginia.And the Reorganized Government gave its consent to the formation of the new state of West Virginia from part of its territory, so everything proceeded perfectly legally. The Supreme Court agreed in Virginia v. West Virginia in 1870.

West Virginia was a part of Virginia up until the U.S. Civil War. Virginia voted to secede from the Union, and became part of the Confederacy, but the Western part of Virginia weren’t rich farmers, or part of the Virginia aristocracy which depended on large plantation farms using slaves. Western Virginia did not have the flat coastal plains for large-scale farming. The inhabitants depended mostly on small subsistence farms on the steep mountainsides, hunting, and fishing. The Coal Age was just beginning, so large coal-mining operations were just beginning. Indeed, timber was bigger than coal at the time. The small farmers resented the rich “flatlanders” in the East, where most political power resided, and, with no use for slaves, weren't particularly enamored of the Confederacy. Long story short, their representatives made a separate peace with the Union, and Congress allowed them to become a separate State, both as a buffer to the Ohio against Virginia, and as a “poke in the eye” against Virginia and the Confederacy. After the war, Congress was in no mood to help repatriate West Virginia back to Virginia, the West Virginians didn’t favor repatriation anyway, and by then, Virginia had been completely devastated by the war, and was in no position politically, or economically, to take back what had always been a poorer part of the state, so the split stuck.

It actually got pretty involved. Delegates from each county of Virginia met in April 1861 to vote on leaving the US. Of the 49 northwest counties that would become West Virginia, 17 voted to secede, 30 against it, and 2 abstained. Not long after, the first Wheeling Convention was held and the debate began whether they actually WANTED to leave. Many delegates wanted to separate from Virginia then, but they held off as the secession was not set in stone yet. After the May 1861 election, where the secession was put to vote, the Wheeling Convention met again. They decided that since the initial Secession Convention was called by government and not by the people, that it was basically illegal, and any acts coming from it were void, and any officials who acted there had voided their office. The Wheeling Convention met yet again and organized a replacement government, including 2 senators who were immediately recognized as legit by the federal government.So at this point, there were actually 2 complete state governments in Virginia that were on opposite sides of the war. The Wheeling Convention called for a vote to separate from Virginia. The vote was held on October 24, 1861, and it was very controversial. There were a lot of Union troops already stationed in what would become West Virginia, and there were a lot of accusations of bullying at the polls as well as illegal voting.The Convention continued to meet From November 1861 to February 1862 to work out a state constitution and organize everything, and by April 1862, everything was ratified, by May it was up and running and sent the letter for admittance to the Union. Lincoln signed off on it on December 31, 1862, and they were officially admitted on June 20, 1863.After the war, Virginia did try to appeal, stating the formation of the new state was not legal (it is a gray area actually), and several Virginia counties voted to annex West Virginia back into the state. The Supreme Court decided in favor of West Virginia in 1870, and we have been correcting people about NOT being from Virginia ever since.
