Are undercover cops allowed to break the law?
Thanks for asking. I did sort of answer another version of this question earlier, but I’ll recap. So, the basic rule is that you’re allowed to break the law you’re enforcing, which, as I admitted before, sounds awful, but is really quite logical. The law says that people may not possess narcotics (or a host of other things the law’s made illegal, from sawed off shotguns to child pornography). Well, undercovers (and other officers) are allowed to possess those things IF their purpose is to bring a criminal case against someone else. I was allowed to purchase drugs from people, possess them briefly, and then transfer them to someone else (the evidence custodian or the crime lab technician), all of which would be criminal acts if somebody else tried them. The same thing goes for a patrol officer who seizes somebody’s stash in a traffic stop.Note that the exception doesn’t allow me or the patrol officer to take half the dope for personal consumption later or to sell it to another drug dealer. Those would be criminal acts that we could be prosecuted for.As for committing other crimes undercover, I can’t recall offhand ever getting put in that position. I bought lots of other illegal stuff, from automatic weapons to smuggled parrots, and a few times I paid for dope with property that I told the dealer was stolen, but it wasn’t. I couldn’t break and enter or illegally bug people. Consequences for that.The other thing we could do was, in very tightly controlled conditions, deliver drugs. One way was to intercept a shipment (mail, FedEx, courier), and go ahead and take it to the intended recipient. The key for these “controlled deliveries” was that the dope could NOT hit the street or “enter commerce.” As soon as the guy took possession, he was getting busted, basically. The other way was a “reverse undercover” or “sell/bust,” in which we’d be the dealer and have the dope, but as soon as the crook produced the money and took possession, again, he was getting busted on the spot. I didn’t like these deals and thought they were too risky (usually) for the reward. That was looking at it strictly from the UC’s point of view, of course, but hey, it was his/her/my ass that was on the line.Bottom line: Police can break the same laws they’re enforcing. Otherwise, how would any traffic cop or trooper ever catch a speeder? But the same cop can’t just drive 100 mph off duty (or on duty, for that matter) just because he feels like going fast that day. Do that, you should expect to get treated just like any other lawbreaker.Incidentally, I love The Departed, but remember that it’s a movie. And it’s a movie that was originally a Hong Kong gangster film, so it’s… a little unrealistic, shall we say. Jack Nicholson is great, though, as the Whitey Bulger character. Great film.
