Further, polygamy was higher in South India than in the north, and more so among rich and middle-class Hindus." It can be legally challanged too. It is just like school uniform! The best way is to enact UCC with optional/voluntary access. In other words, let all communities follow their practices subject to the aggrieved party’s right to seek judgment under UCC, binding to all parties. Easy divorce system like Muslims’ can also be adopted if the couple is not willing to stay together anymore. In America, divorce rate is more than 50% against 8 % in India.Should bigamy be incorporated in UCC, whether mandatory or optional?As seen above, one crore Hindu women at present do not have equal legal and social rights available now to 12 lakh Muslim women. Despite bigamy allowed for Muslims, their % share is less than Hindus. Just like child marriage, bigamy will never cease to exist despite low female ratio to male. In the eventuality of bigamy being banned in UCC, Muslim women (12 lakh) will lose equal rights. This is contrary to the intent of UCC being argued! If bigamy allowed in UCC, it will be more beneficial to non-Muslim women than Muslim in regard to their social and legal status! Further, non-Muslims will not require to convert to Islam being more misused by others for marriage than Muslims at present. This is what Law Commission also desires viz. preventing conversion of non-Muslims to Islam!How can UCC be made optional very simply?Simply by incorporating one clause in all community laws that optional UCC will override their provisions if an aggrieved party seeks justice under UCC.ConclusionTraditions change in different times. What was the position in Lord Rama’s Treta Yug was different from Lord Krishna’s Dwapar Yug despite both being Avatars of one Vishnu. So let us change too with times.So personally, I do not mind UCC with a further wish if it is made optional initially with a provision to extend equal rights to all female victims of bigamous marriages, existing and future, and also sort of an easy divorce system. Later on, it can be made mandatory since old habits die hard!
