on behalf of Mr sivia the applicant who sits behind me my learning friend Mr Stables is for Miss Riley yes and my Lord the timings were set out in a note it's very helpful thank you thank you for sorting that out that's that seems quite appropriate um in terms of the first ground the challenge concerning um section 4-2 of the defamation act 2013 and what we say is the failure of the judge to have regard to all of the circumstances of the case my Lord would have seen the there is a legal point that Mr Stables takes in his respondent statement along the lines of the re-sprint room test to do with challenges against findings of fact and by way of introduction what I say about that my Lord is is two things firstly what we are concerned with here is not an orthodox challenge against factual findings and whether or not the urgency of the judgment is affected because of any um failure to take out material Factor Etc that might be an issue what we say is that this is a more fundamental challen
