A counselor must strive to be as unbiased as possible. It’s not ethical to use information gained from an outside source or a third party when working with a client. Counselors who use unethical practices run the risk of censure from their accrediting agency and possible lawsuits for unethical behavior.If a counselor is already seeing a married person, he or she would most likely not take on the other partner. The reason that would have to be given is that they already have as many clients as they feel they can handle, and then offer to refer them to another counselor. A counselor cannot disclose any personal information about their clients, or even that a certain person IS their client, to anyone who doesn’t have a legitimate need to know, or without a court order.If a husband and wife both feel they need to see a counselor, why would they hide that fact from the other? If they feel they should, that’s something that should be discussed.

The laws are pretty clear. Maryland is a "two-party consent" state when it comes to recordings, so one cannot make recordings (with or without video) without the consent of the party to be recorded.  Md. Code Ann., Courts and Judicial Proceedings § 10-402.  Courts in Maryland have interpreted this statute to have an "expectation of privacy" element; that is, one party may record another without permission so long as the second person has no reasonable expectation of privacy at the time the recording is made.  See Malpas v. Maryland, 695 A.2d 588 (Md. Ct. Spec. App. 1997).  Obviously, however, one has a strong expectation of privacy when being medically examined, especially by a gynecologist.  Moreover, it is also a crime in Maryland to conduct video surveillance or take photos in a private place--which would include an office setting--to view the "clad genitals, pubic area, buttocks, or female breast of an individual" for prurient purposes.  Md. Crim. Law § 3-902.  This criminal statute gives rise to a civil cause of action for victims.  Id.  And finally, there are numerous state and federal laws--too many to mention here--requiring heightened privacy when it comes to one's medical information.  Therefore, even assuming for the sake of argument that it was somehow legal for a physician to videotape one's patients without their permission--which again, it is not--one could not take the video home for a personal collection.  Bottom line, this doctor behaved in  a grossly illegal manner and violated multiple laws.  Had he not killed himself, he would have been looking at a lengthy prison sentence.Although the $190 million settlement is eye-catching, when you account for the number of victims and the fact that lawyers will have to be paid from the settlement fund, this likely amounts to less than $20,000 per victim.  In similar cases where there were smaller numbers of victims, judgments have been ten times higher, or more.  E.g., 4 Women Awarded Judgments After Managers Secretly Videotape Them Undressing.  There is obviously a gross violation of privacy in being videotaped in a dressing room or shower, but I would imagine that the average person would suffer far more emotional distress from being surreptitiously recorded by their physician.  On an individual basis, it would not have been unrealistic for the victims in this case to have sought damages in the mid-high six figures, or even low seven figures.  It is therefore unlikely that this case will have a great effect on future matters--because of the extraordinary number of victims, my best guess is that many of the doctor's patients will in fact be substantially under-compensated compared to what they would have received had they been lone victims, or part of a small group of victims.
