I’m skeptical of the claim that others have made that he had trouble getting a US driver’s license, as two days (at Stanford) would have been long enough to apply for a driver’s license and a US social security number. As I said—these things weren’t checked all that closely in the 1990’s. Plus he’d studied at another US school pre Stanford giving him more time to establish himself in the US. Musk’s brother Kimbal—OTOH—who never studied in the US might have had a bit more trouble getting a driver’s license and US social security number during this phase.So—yes—Musk was probably technically out of status for a period of time following his Stanford withdrawal but there were few if any consequences to this at the time. Once Zip2 was funded in 1996 by VC’s, the VC’s would likely have both offered to—and insisted upon—helping get his immigration status on a firmer footing. VC’s—even in the looser 1990’s—wouldn’t have wanted to fund a company with founders in a questionable status. So since he got his green card by 1997, we can infer that he got his green card in about a year (from 1996 to 1997).That’s actually fairly fast for a green card, which implies that he got his green card by a fairly fast mechanism. Two fairly fast mechanisms are the so called “national interest waiver” and the “alien of extraordinary ability” route. I’m guessing he didn’t go the “alien of extraordinary ability” route. Although Musk has certainly done extraordinary things after getting his green card, his track record before getting his green card doesn’t seem strong enough to warrant an extraordinary ability claim. So I think he probably went the “national interest waiver” route which allows one to bypass the first step in the green card process—allowing for a faster green card—by claiming it is in the US “national interest” to do so. The final stage in the green card process would have been faster too because he could have done it at a US consulate in Canada as a Canadian citizen.So—although I do not know for sure—I’m guessing he followed roughly the following steps: he obtained a student visa to study at Stanford.
