Names have been charged or obfuscated to protect the guilty (and because I don't want to prejudice my case against them if they dare step up on me and mine again)Note: I Am Not An Attorney and this is not legal advice. This is merely a discussion of my experience dealing with corporate fascist fuckwits. I don't recommend my course of action or tactics because it takes a Particular Sort of Asshole Man to pull it off. Look folks, if y'all need legal advice go hire a damned attorney. DO NOT EVER rely upon “how other people did it” from the internet.Even if I were an attorney, I am not YOUR attorney.A pack of carpet bagging rascals we'll call WtF NTSA listed her on the student loan as a “cosigner” without her knowledge, permission, or signature in any part of the loan origination process.They began trying to collect from her by selling the paper to a collection agency whom she initially told to GFY. Unfortunately she didn't know that the Go Fuck Yourself message needed to be conveyed in writing and using specific terms and phrases in order to be legally effective. I did know..When she asked me about it after the fifth collection letter I drafted a formal letter to the collection agency with a nice CC and cover letter to the WtF NTSA legal department disputing the supposed debt and demanding full copies of the originating documents and sent everything Registered Mail, Return Receipt. I may have been somewhat less than polite in the letters, and I'm pretty sure I used phrases like “contact only via US Mail” “originating paperwork for this supposed debt with signatures” “fraudulent collection practices” along with “Under the FCCA and FCRA...” and something about “$10,000 per occurrence of violation in punitive damages alone.”They got the message 5x5.*crickets* for 6 months.Then the cuntmuffins at WtF NTSA sold the paper again to a different collection agency (knowing full well this was a fraudulent collection). I got the first demand letter from DW.My response was to photocopy the original demand letters from the first collection agency, my response to them, the return receipt, the original dispute letter to WtF NTSA and that return receipt and then I drafted a fresh new cover letter stating that both WtF NTSA and the new collection agency were now in joint and several, provable, documented, violation of the 1986 Fair Credit Collections Act and the Fair Credit Reporting Act. I then went on to explain that what they both were doing amounted to conspiracy to commit collections fraud and that in addition to being criminally liable for that, they were ALSO liable to us for at least $20,000 in punitive damages, in addition to any fines for each fraudulent collection attempt, under each of the FCCA and FCRA. The total in just punitive damages would be in excess of $20,000 for this agency and in excess of $60,000 for WtF NTSA because they and their now two collection agencies had already made +8 fraudulent collection attempts between them after WtF had notice (via DW and her phone conversation with WtF NTSA some 10 months prior) that their collection attempts were fraudulent.I then cited chapter and verse of the sections of the two acts which dealt with fines and punitive damages. It turned out I was a bit light in my estimates of potential punitive damages by $30k or so but I didn't mention that. (Thanks LII and LexisNexis!) I also think I mentioned that I'd be more than happy to meet their attorneys in court in San Francisco if they didn't clear the fraudulent debt against my wife immediately.I mailed full copies of the whole mess to both the WtF Legal department and to the new collection agency. I got a call from the Legal department at WtF a few days after I got the return receipt card back. I then said “Darlin, the ball is now Officially in your court. I have all my records and some very interesting case law citations which I'd positively LOVE to try out in court. I'll await your decision. In writing.” and hung up.We got a very nice letter about a week later from the collection agency “explaining” that “through some terrible mistake” my wife's name had been “mixed up” with “another person of the same name” and that her account had been resolved by the originating bank.
