I am quite sure that VW will never pay that. There have been other mistakes made by other car makers which definitely killed people. None of them ever paid more than $1 Bn. If VW should be forced to pay such an enormous sum of money, it would result into a dramatic loss of tax revenues in Germany. The Federal State of Lower Saxony holds 20 percent of the VW shares and has the power to rule out many VW decisions, so VW si partly run by the government. So, if an US agency should threat a German company with such a high penalty that it affects german economy as a whole, German government would take that as an act of economic war. They would not accept that without a proper answer. There are many US companies acting in Germany which also are under allegations of not obeying German laws, just think about Google and Facebook. Currently the EU is negotiating TTIP with the U.S.. Claiming 18 Bn. from one of the largest companies of Europe could interfere with that. So I am pretty sure that there will be a political solution for that. 2. VW has some 500.000 cars sold in the U.S. which do not meet U.S. emission laws. They will have to correct the problems and they will have a battle with greedy lawyers trying to squeeze out VW like a ripe lemon. This will cost them some billions. Either they will have a battle for years before court, or they decide to finish off with the whole mess by paying a fortune. Option two may have the advantage of getting them the cance to get rid of the image problem.3. The problem outsides the U.S. is far bigger: VW sold about 11 million engines which do not meet Emission standards, most of them all over Europe. So they will have to retrofit some parts to every single engine sold. Just calculate that this will cost them 500 Dollar per engine (which is a rather low estimate), this will cost them at least 5.5 Bn. They will also face allegations and charges of various authorities around the globe. None of them has claimed such an enormous amount of money like the EPA, but to have trouble with 20 administrations around the world is also a big, big problem.4. VW has destroyed public trust in their most important technology, the TDI Diesel engine. TDI used to be the USP of VW. Currently VW does not sell Diesels in the US. VW Diesel sales dropped sharply in many EU markets. VW used to sell the most fuel efficient internal combustion cars. They will have the need to find another USP. Just recently they introduced two fully electric cars, besides that they introduced several plugin hybrids. Although I think that these cars are pretty interesting, VW is not the first mover in that field, so this may not be suitable as new USP.5. EU law demands from all car manufacturers to limit the average CO2 footprint per car to 95 g per km by the year 2020. The German car industry has expressed their opinion, that they will not be able to signNow that goal without the Diesel technology. VW used to be the biggest Diesel passenger car manufacturer on earth. If they lose their reputation for making good Diesels, they have a big problem both to stay in the market and to comply with EU laws.On the other side I am quite optimistic that VW will survive this crisis. In 2015 they were the company with the biggest R&D budget on earth (more than 4 times as big as Apple R&D). If any big car maker has the resources to quickly change its basic techology, then it is VW. Besides this: they are too big to fail. If they require help from the government they will receive it. And: 45 years ago they have done a similar thing. They converted their complete fleet of vehicles from pre-war technology (aircooled boxer engines, frame platform, rear wheel drive) to contemporary technology (liquid cooled inline engines, self supporting unibody platform, front wheel drive) within four years.

BMW and Mercedes solved the emissions problem by using more expensive solutions (urea injection). Those system are problematic but the cars cost more money so there's more room for warranty costs.
