At the same time, I also know some of the issues being faced myself.In principle, GST is a good move, let’s get this out of the way to avoid people jumping on me saying that I am opposing the government. That’s not what this is about. I am not here to talk about theoretical aspects; I am focusing on the implementation, and the practical difficulties being faced with it.Let’s get started.#1] No return filing without paying taxes in fullThis is not a short term thing, it’s a practical issue which needs greater deliberation. GST portal does not allow us to file returns without paying taxes in full. That makes no sense to me.By filing the return, I am telling the government that I owe them. After this, if I don’t have the money now, at least let me file the returns, right? What’s so wrong with that? If I make the payment late, I can always pay interest on the same, and I will. But, by not allowing me to file returns, the government is forcing me to pay the penalty as well. And this is just plain wrong.It is possible that some businesses might not have the money at the same moment. That does not mean they are doing anything illegal. So late fee and penalty makes no sense. Although the government has been so ‘generous’ to forgive the late fee in the starting month, they should consider this from a long term view as well.#2] GST portal not readyWell, this is the best way I could have said it. Because, in reality, I feel like scratching my head right now. The portal is not at all ready, and it is disgusting, the way it is operating right now.Offline utility tools are not working. That is, in order to type “1” and “5”, the portal takes hours.On top of that, taxpayers are getting notices that there will be a late fee for not filing the returns on time. It’s like not opening the gates when we are desperately trying to enter, and then punishing us for not entering.#3] Transition is not smoothGST registration and returns is not as simple as I thought it would turn out to be. I agree that I had previously written that it will be easy, but it’s not. And this is mainly due to the following issues -There is no clarity - in provisions like invoicing, payment vouchers, reverse charge invoices - we are not sure what we are actually supposed to do. As a result of this, even though you take a call to do something, you end up feeling like a criminal.Registration is also a very hectic exercise. I have spent hours of my time and that of my staff on finding the relevant jurisdiction. This is ridiculous. How are we supposed to know all the locations of all the cities and states in the country, for example?Even the transition forms are very badly managed. The law gave us 90 days to file the transition form, but it was only available on the portal on 20th, and was supposed to be filed within 8 days if we want to use the opening credit. So, just because the IT infrastructure is not ready, the taxpayer has to pay money even though, as per the law, he is not supposed to pay.It hurts when people need to spend money just because the portal is not being managed properly. For example, even though the government had said that they will not charge late fee for delay in return, the portal was not allowing the file the return unless the late fee is paid. By the time they corrected it, tens of crores had already been collected!Here’s what I feel: the government was not ready.I agree that nobody can be completely ready for a step as big as this. However, basic checks should have been implemented. Rigorous testing should have been carried out.More importantly, more time should have been given to people to prepare for the portal. We should have had cold runs, trials, offline trials etc. The offline tools should have been released months before the last dates. But the reality is that they are released days before the last date arises (for example, in case of Excel utility for filing of C-Forms in the TRAN-1 form).Tax consultants and CAs can still learn things faster, it’s a trouble to explain everything to the taxpayers and their accountants and other employees. GST does not affect only the accounting or tax teams, but also the logistics, sales, purchase, marketing, finance and operations teams.And a bit of a rant: the life of various Chartered Accountants have become miserable. There are last dates almost every week, until they are postponed, to another holiday. This Sunday, for example, is another last date for filing of return (as I write this).On top of that, the mistakes in some returns are proving to be quite costly. The government had announced that mistakes in the summary return GSTR-3B can be corrected in the next return, but the portal is not allowing that to happen. The truth is, what they say and what appears on the portal is not in sync.I am a very patient man. People who know me personally would vouch for it. But I am quickly losing my patience over this. It would be alright if they extend the implementation targets by a little bit and just accept that they screwed up but are now working to ease it for everyone.That’s exactly what they are doing (I hope), but they are not saying it.
