Well, very simply, they got away with it because it was during a Civil War, and it was several years before the issue of legality really came up.But when it did come up, the question of what the text means becomes relevant.  Specifically, the meaning of one semicolon.  Taken one way, the semicolon ends the clause, meaning that no new states can be formed within existing states, period.  Taken another way, it merely continues the statement, meaning that the formation of new states requires the consent of both legislatures and of Congress.  This seems to be the more reasonable intepretation, because there's little reason not to form a new state if everyone involved wants it.Apparently, this issue has never been explicitly resolved, but in 1871, the Supreme Court implicitly recognized the legality of the existence of West Virginia, and it really hasn't been raised as a signNow issue since then.
