What is the W-9 Form?
The W-9 form is an IRS document used by individuals and businesses in the United States to provide their taxpayer identification information. This form is essential for reporting income paid to independent contractors, freelancers, and other non-employees. The information collected includes the name, business name (if applicable), address, and taxpayer identification number (TIN), which can be a Social Security number or an Employer Identification Number (EIN). Understanding the purpose of the W-9 form is crucial for both payers and payees to ensure accurate tax reporting and compliance with IRS regulations.

Completing the W-9 form involves several straightforward steps:
- Download the Form: Obtain the latest version of the W-9 form from the IRS website or a trusted source.
- Fill in Your Information: Provide your name, business name (if applicable), and address in the designated fields.

Legal Use of the W-9 Form
The W-9 form is legally binding and must be filled out accurately to avoid penalties. It is primarily used for tax purposes, allowing payers to report payments made to non-employees to the IRS. Misrepresentation or failure to provide the correct information can lead to tax withholding or penalties. It is important to understand the legal implications of submitting a W-9, especially for businesses that rely on independent contractors and freelancers.
IRS Guidelines for the W-9 Form
The IRS has established specific guidelines for the use of the W-9 form. These guidelines include:
- Ensuring that the form is completed in its entirety before submission.
- Providing accurate taxpayer identification information to prevent issues with tax reporting.
- Understanding that the W-9 form does not need to be submitted to the IRS but must be kept on file by the requester.
- Recognizing that the IRS may request the form during audits or inquiries regarding reported income.
Examples of Using the W-9 Form
The W-9 form is commonly used in various scenarios, including:
- Independent contractors providing services to a business.
- Freelancers submitting work to clients.
- Landlords receiving rental income from tenants.
- Individuals receiving interest or dividends from financial institutions.
In each of these cases, the entity requesting the W-9 form needs the information for accurate tax reporting and compliance.
Filing Deadlines and Important Dates
While the W-9 form itself does not have a specific filing deadline, it is essential to submit it promptly when requested. Businesses typically need the W-9 completed before issuing a 1099 form at the end of the tax year. Ensuring timely submission helps avoid delays in tax reporting and potential penalties for both the payer and the payee.

Why did my employer give me a W-9 Form to fill out instead of a W-4 Form?
I wrote about the independent-contractor-vs-employee issue last year, see http://nctaxpro.wordpress.com/20...Broadly speaking, you are an employee when someone else - AKA the employer - has control over when and where you work and the processes by which you perform the work that you do for that individual. A DJ or bartender under some circumstances, I suppose, might qualify as an independent contractor at a restaurant, but the waitstaff, bus help, hosts, kitchen aides, etc. almost certainly would not. There's always risk in confronting an employer when faced with a situation like yours - my experience is that most employers know full well that they are violating the law when they treat employees as independent contractors, and for that reason they don't tolerate questions about that policy very well - so you definitely should tread cautiously if you want to keep this position. Nonetheless, I think you owe it to yourself to ask whether or not the restaurant intends to withhold federal taxes from your checks - if for no other reason than you don't want to get caught short when it comes to filing your own return, even if you don't intend to challenge the policy.

I received my late husband's W-9 form to fill out for what I believe were our stocks. How am I supposed to fill this out or am I even supposed to?
You do not sound as a person who handles intricasies of finances on daily basis, this is why you should redirect the qustion to your family’s tax professional who does hte filings for you.The form itself, W-9 form, is a form created and approved by the IRS, if that’s your only inquiry.Whether the form applies to you or to your husband’s estate - that’s something only a person familiar with the situation would tell you about; there is no generic answer to this.
