While there is no specific amount a late fee can or cannot be, many use 5% of the monthly rent as a standard. Honest landlords do NOT want to collect late fees, they want to have the rent paid on time. Landlords still have to pay the mortgage, taxes and insurance on time, and those entities don’t care if your rent to cover those payments wasn’t paid on time; they just want their money, otherwise they will impose late fees on the landlord. A reasonable landlord might give you the benefit of the doubt if you let them know in advance that the rent is going to be late, provided you have a good reason and it has not been a recurring issue. And, late fees, while they can not be of a punitive dollar amount, ARE in fact designed to be punitive to discourage habitually late rent payments. Otherwise, some tenants would just pay the rent whenever they feel like paying it. As a landlord, I would not hesitate to enforce late rent fees against a tenant who consistently paid late. I would also never renew their lease. If you are in a situation where your rent is going to be late, LET THE LANDLORD KNOW! If you are going to be continually late for a good reason (for instance, if you change jobs and your payday is now on the 10th of the month) ask to negotiate a change of rent due-date with the landlord. Good communication with your landlord goes a long way toward a happy landlord-tenant relationship, as does making sure you can afford to pay the rent on-time every month BEFORE you sign the rental or lease agreement.
