In the Hong Kong SAR, how do you know if you were registered for a BN(O) Passport before the 1 July 1997 deadline?
Forgive me for saying this, but this is really an oddball question. You have only 2 ways of knowing this:—If you hold a BN(O) passport, it means you’ve been registered for one by yourself or by your parents. Doesn’t matter if you use it or allow it to lapse (expire from long disuse). You continue to hold that status — unless facts in your situation indicate you had given up that status in some ‘official’ manner. If you’ve NEVER held one, you have NEVER been registered for it and have lost access to the BN(O) after 30 June 1997.If you got the passport, you’re registered. If you’re registered, you got the passport. The BN(O) registration and passport application were the same procedure. There were no separate registration and application. It’s impossible to have been registered yet not have the passport.Below is the long explanation:—ONLY ISSUABLE VIA APPLICATIONYou had to apply for the BN(O):—It was not issued automatically even to eligible persons by the UK and Hong Kong authorities. It was available only to those who applied for it with the Immigration Department in Hong Kong and/or UK authorities during ca. 1985/87–1997.The application process was also the registration process. The Immigration Department will have checked for eligibility under the terms of the British Nationality Act 1981 (1981 c.61) and the Hong Kong Act 1985 (1985 c.15) plus their relevant Orders. If the applicant was eligible, then the BN(O) will have been issued anyway.WHO WERE ELIGIBLE?Fully eligible were the BDTCs (British Dependent Territories Citizens) with a connection with Hong Kong (e.g. birth, naturalisation, etc). BDTCs who didn’t apply for one during 1985–97 have lost access to the BN(O) after 30 June 1997.Other Hong Kong ‘belongers’ who held various identity or travel documents (e.g. Hong Kong Certificate of Identity) have had to (1) first naturalise to the BDTC and then (2) apply for the BN(O) as above. These people who didn’t naturalise from ca. 1983 have lost access to the BDTC and therefore the BN(O) after 1997.CONTINUING STATUSYou continue to be BN(O):—when you still hold the BN(O) and still using itwhen you still hold the BN(O) but have stopped using itwhen you still hold the BN(O) but have never used itAs long as you have never given up your BN(O), your status continues. You continue to have the right to renew it with the UK authorities and some British agencies worldwide.STATUS LOSTYou have lost your BN(O) status or access:—by not applying for BN(O) before 1997by not naturalising to the BDTC during 1983–97 for eligibility for the BN(O)by giving up the BN(O) in an official way (e.g. naturalisation to another nationality, notice of giving up to the UK authorities, etc)HKSAR PASSPORTApplying for and/or holding the HKSAR passport isn’t normally considered as giving up the BN(O) status. Thanks for the A2A.
