Do not talk to the police if you believe that you may be a suspect or person of interest. Assert your right to remain silent. Ask for an attorney. State that you will not answer any questions until an attorney is present. As a rule, the attorney will advise you not to answer any questions at all.The police are not your friends. They are not interested in finding the truth. Mainly they are nterested in closing a case by making an arrest. If you give them any basis to do so, you will do as well as anyone else as someone to arrest. All you can do by talking to the police is give them material that can be used against you either as the basis of charges or in a court of law.This is independent of whether you are Mirandized. The law says that people must be advised of their rights if they are in a custodial situation. They do not apply to statements that you may volunteer, or if the police simply start talking to you, as they or anyone else may talk to anyone. Nor do they apply if you waive them by answering questions after having been advised of your rights.If you are approached by the police, do not give consent for them to search your home or your person or vehicle. Do not let them into your home. Unless of course they have a warrant. Ask if they have a Warrant and ask to see it. Have them put it under the door. If one of the warrant exceptions applies, you will know it, because they will knock down your door.You can also refuse to let them search your person in other places, for example, on the street. they may or may not honor that request, but at least in theory, if they find something when you have refused to search and they do not have a warrant or other probable cause, it can be suppressed. Do not be surprised if they lie about your consent.The police may wheedle and try all kinds of tricks to get you to talk. "It will be better for you if you cooperate .” That is not true. “If you have nothing to hide, there is an any reason for you not to talk to us.” Yes, there is. It allows them to pat you on the outside of your clothes but not go into your pockets or inside your clothing at all unless they feel something that might be a weapon. The rationale for the patdown is to protect the police against possibly armed suspects. They cannot detain you for any longer than a brief conversation and a pat down.If stopped by the police, and they have not otherwise made it obvious by handcuffing you will or putting you in a squad car, you can ask, and I am under arrest, am I free to leave? If they say you are free to leave, then do so, slowly, gingerly, and politely.Generally the police do not have the right to force answers to any questions, but some states, and Illinois is one of them, have statutes that allow the police to ask you to identify yourself and state where you were going and where you came from. Likewise, do not run from them or make any sudden movements around them that might alarm them.Do not signNow in your clothes unless you have to, for example, if directed to produce your drivers license while driving. Passengers need not produce any identification. Explain clearly and politely that you are getting your wallet, and do so in such a way that your gestures or unmistakably nonthreatening.In general, do not talk to the police unless so advised by your attorney. Say repeatedly, I am certain my right to remain silent and I want to talk to a lawyer. It's a good idea to memorize the number of a lawyer or someone who knows the number of a lawyer. Do not give consent to search. Ask to see the warrant. Ask whether you are free to leave unless it is obvious that you are not.These are your rights. Use them.

Get referrals, and consult with lawyers that someone you trust has used. Even if that lawyer can’t help you, they may know who to refer the matter to.That’s just finding the lawyer. Once you start a relationship, you should be setting expectations, and evaluating how the attorney is delivering on those expectations. If the attorney says, “I’ll have papers for you by next week,” then follow up and be sure that expectation is met. Good attorneys communicate if there’s a problem.You’ll be able to evaluate: is the communication good quality? Is it timely? Are the budget expectations being respected? Do we appear to be on target to the objective?But really, in so many ways, it’s the same as how you evaluate any other professional or vendor.
