7.06b Example 3: Clause Setting Forth the Standard Measuring Method to Be Used for Remeasurement When the actual measurements are to be determined, it is important to use a standard measurement method delineating the beginning and ending points for measurements as well as the deductions for nonusable space, such as columns or shaftways. One such clause is as follows: "Usable Area" shall mean the area, in the case of a single tenancy floor, within the exterior walls of the New Building, or, in the case of a multiple occupancy floor, within the exterior walls, party walls or corridor walls, as the case may be, (subtenants of the Tenant being disregarded in the determination of whether a floor is a single tenancy floor or multiple occupancy floor for purposes of ascertaining the usable Area of the Demised Premises) computed by measuring from or to: (a) the inside surface of the exterior wall (except that if it consists in whole or in part of glass, then to the inside of such glass for the entire wall), (b) the center line of any wall common to the Demised Premises and any area to be excluded as hereinafter provided, (c) in the case of a multiple occupancy floor, the center line of any party wall separating the Demised Premises from other rentable space and the corridor side of any wall separating the Demised Premises from any public corridor or elevator lobby, but excluding from such area the area of any public stairs, fire tower and fire tower court, and public elevator shafts and machine rooms (with their finished enclosing walls, subject to (b) above).
