ACCOMMODATION RENTAL AGREEMENT

Parties and Recitals

This Accommodation Rental Agreement (the "Agreement") is entered into by and between Landlord: and Tenant: .

WHEREAS, Landlord is the lawful owner or authorized agent of certain accommodation and related fixtures described below; and

WHEREAS, Tenant desires to lease the accommodation for temporary residential occupancy in accordance with the terms set forth herein; and

WHEREAS, the parties wish to set forth their entire agreement regarding the occupancy, payment, maintenance and responsibilities associated with the accommodation.

Property

Scope of Accommodation and Services

The accommodation shall be provided together with the following included furnishings, utilities and services as described by the parties below. Items omitted are excluded from the tenancy unless otherwise agreed in writing.

Early termination by either party requires written notice as set forth below and may be subject to fees and obligations for rent and damages incurred prior to the effective termination date.

Payment Terms

Use, Occupancy and Restrictions

The accommodation shall be used solely for residential occupancy by the Tenant and the following permitted occupants:

Subletting, assignment or sharing of the accommodation is prohibited without the prior written consent of Landlord. Tenant shall comply with all house rules and shall not engage in any unlawful activity on the premises.

Repairs, Maintenance and Entry

Landlord shall maintain the structure, major systems and agreed services in a habitable condition. Tenant shall keep the accommodation reasonably clean and shall promptly notify Landlord of required repairs. Tenant shall be liable for damage caused by Tenant's negligence or misuse.

Landlord may enter the accommodation upon reasonable notice for inspection, repairs or to show the accommodation to prospective tenants or purchasers, except in emergencies when no prior notice is required.

Insurance and Liability

Tenant is encouraged to obtain renter's insurance covering Tenant's personal property and liability. Landlord's insurance does not cover Tenant's personal property. Tenant indemnifies Landlord for claims arising from Tenant's breach, negligence or willful misconduct.

Confidentiality

The parties acknowledge that certain information exchanged in connection with the tenancy may be confidential. Each party agrees not to disclose personal or financial information of the other except as required by law or for enforcement of this Agreement. Confidential information does not include information that is publicly available through no breach of this obligation.

Default and Remedies

If Tenant fails to pay rent or otherwise materially breaches this Agreement, Landlord may pursue all remedies available at law or in equity, including termination of tenancy, collection of rent and damages, and recovery of costs and reasonable attorney's fees. Tenant may cure breaches where applicable by promptly remedying the default within any cure period required by law.

Term and Termination (Detailed)

This Agreement shall continue for the term set forth above and, unless otherwise stated, shall not automatically renew. On expiration, Tenant shall vacate and surrender possession in good condition, ordinary wear and tear excepted. Failure to vacate may subject Tenant to holdover damages and other remedies.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state where the accommodation is located. The parties submit to the jurisdiction of the courts located in that state for resolution of disputes arising under this Agreement.

Entire Agreement

This Agreement, including any attachments and written amendments signed by both parties, constitutes the entire agreement between Landlord and Tenant relating to the accommodation and supersedes all prior negotiations and representations. No oral statements shall modify this Agreement. Any modification must be in writing and signed by both parties.
