4. Financing Contingency

This Agreement is contingent upon Buyer obtaining financing in the amount of $ within days after effective date. If Buyer fails to obtain financing within the contingency period, Buyer may terminate and receive return of the earnest money unless Buyer waives the contingency in writing.

9. Representations and Warranties

Buyer acknowledges reliance on Buyer's own inspections and investigations, except as expressly stated herein.

10. Default and Remedies

If Buyer fails to close in accordance with this Agreement other than as permitted by contingencies, Seller may retain earnest money as liquidated damages or pursue specific performance or other remedies at law or equity. If Seller fails to convey title as required, Buyer may seek specific performance or termination and return of earnest money. The parties agree that remedies available at law and equity are cumulative and the prevailing party shall be entitled to recover reasonable attorney's fees and costs.

11. Miscellaneous

Entire Agreement: This Agreement, including all attachments, exhibits and addenda, constitutes the entire agreement between the parties and supersedes all prior negotiations. Amendments must be in writing and signed by both parties.
