3. ASSUMPTION OF RISK

Participant acknowledges and agrees that participation in the Activity involves inherent risks, including without limitation risk of serious bodily injury, permanent disability, paralysis and death, as well as property loss or damage. Participant knowingly and voluntarily assumes all risks associated with participation, whether foreseen or unforeseen, inherent or otherwise, and regardless of the cause thereof except as limited by law.

4. RELEASE AND WAIVER

To the fullest extent permitted by law, Participant hereby releases, waives, discharges, and covenants not to sue Organizer and its respective officers, directors, employees, volunteers, agents, contractors and affiliates (collectively, "Released Parties") for any and all liability, claims, demands, causes of action, damages, losses and expenses, including attorneys' fees and costs, arising out of or related to Participant's participation in the Activity, whether caused by the negligence of the Released Parties or otherwise, except for claims arising from the gross negligence or willful misconduct of a Released Party.

5. INDEMNIFICATION

Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, damages, liabilities, losses and expenses (including reasonable attorneys' fees) brought by any third party arising out of or in connection with Participant's acts or omissions, breach of this Agreement, or violation of any law or rule while participating in the Activity.

6. MEDICAL AUTHORIZATION

Participant authorizes Organizer, at Organizer's discretion, to obtain emergency medical treatment for Participant if necessary and agrees to be financially responsible for any such treatment. If Participant is a minor, the undersigned parent or legal guardian authorizes such emergency treatment and further represents that he or she has the authority to provide this consent.

7. PARTICIPANT REPRESENTATIONS

Participant represents and warrants that: (a) Participant is physically and mentally capable of participating in the Activity; (b) Participant is not under the influence of alcohol, controlled substances, or prescription medication that would impair safe participation; (c) Participant will comply with all instructions, rules, and safety procedures provided by Organizer; and (d) Participant will promptly report any unsafe condition or incident to Organizer.

8. MEDIA RELEASE

Participant grants Organizer the perpetual, royalty-free right to use, reproduce, publish, and distribute Participant's image, likeness, voice, and performance in any media now known or hereafter developed for promotional, educational, or any other lawful purpose without further approval or compensation, subject to any applicable law.

9. INSURANCE

Organizer does not represent or warrant that it carries insurance to cover Participant. Participant is encouraged to obtain and maintain adequate health and accident insurance to cover medical expenses that may result from participation in the Activity.

10. TERMINATION

Organizer may, in its sole discretion, remove or refuse participation to any person whose conduct or condition presents a risk to the health or safety of others or disrupts the Activity. No refund or other compensation shall be payable as a result of such removal, except as required by Organizer policy.

11. NOTICES

All notices, requests, consents and other communications hereunder shall be in writing and delivered to the addresses set forth in the opening paragraph or to such other address as a party may designate by written notice to the other party in accordance with this Section.

12. AMENDMENTS; WAIVER

This Agreement shall be governed by and construed in accordance with the laws of the State of without regard to its conflicts of law principles. The parties submit to the exclusive jurisdiction of the state and federal courts located in that State for resolution of disputes arising under this Agreement.

14. ENTIRE AGREEMENT; SEVERABILITY
