Assumption of Risk and Release

I, the undersigned Participant, voluntarily elect to participate in the activity identified above. I understand that participation involves inherent risks which may include serious bodily injury, property damage, permanent disability or death. I acknowledge that I am solely responsible for evaluating the risks and for my own safety at all times during the activity.

In consideration of being permitted to participate, I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the Organizer, its officers, directors, employees, agents, volunteers, contractors and affiliates (collectively, the Released Parties) from any and all liability, claims, demands, actions or causes of action for injury, loss, or damage to person or property arising out of or related to my participation, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

Indemnification

I agree to INDEMNIFY, DEFEND AND HOLD HARMLESS the Released Parties from and against any and all claims, liabilities, losses, damages, costs and expenses (including reasonable attorney fees) arising from or related to my participation in the activity, including claims brought by third parties or my own family members, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.

In the event of injury or illness, if I am unable to make medical decisions, I authorize the Organizer to obtain emergency medical treatment for me and permit medical personnel to provide necessary care. I agree to be responsible for all costs associated with such treatment.

I grant the Organizer the right to photograph, record, and use my likeness in promotional materials, publications, and media, without compensation, unless I have indicated otherwise below.

Minor Participant

If the participant is under 18 years of age, a parent or legal guardian must sign below and by signing acknowledges the authority to consent on behalf of the minor and accepts the terms of this agreement.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state in which the activity is conducted, without regard to conflicts of law principles.

Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement: This document constitutes the entire agreement between the parties concerning the subject matter herein and supersedes all prior oral or written communications.
