Consent and Relinquishment

Birth Parent(s) hereby give voluntary, informed consent to the adoption of the child by Adoptive Parent(s). Birth Parent(s) acknowledge that they have had the opportunity to obtain independent legal advice and that their consent is not induced by fraud, duress, or undue influence. Birth Parent(s) agree to execute any legal instruments required to effectuate the lawful transfer of parental rights when so ordered by a court of competent jurisdiction.

Representations and Warranties

Each party represents and warrants that: (a) the information provided in this Agreement is true and correct to the best of that party's knowledge; (b) there are no legal impediments known to that party which would prevent the adoption; and (c) no other person has superior legal claim to custody of the child except as disclosed to the other party in writing.

Placement, Custody, and Legal Proceedings

Placement of the child with Adoptive Parent(s) is agreed to commence on unless otherwise ordered by a court. Adoptive Parent(s) will file or cooperate with the filing of any petitions necessary to finalize adoption, and both parties will attend court hearings as required.

Financial Arrangements

Adoptive Parent(s) agree to reimburse reasonable prenatal and birth-related expenses incurred by Birth Parent(s) in the amount of subject to documentation and applicable law. No payment shall be made that constitutes payment for the child. Any other agreed-upon expenses are described below.
