RECITALS

SCOPE OF CARE

The parties agree that Adopter will assume primary care and custody of the animal and will comply with the care plan, veterinary requirements, and behavior plans specified below.

As consideration for the adoption and transfer of custody, Adopter shall pay the Adoption Agency the fees and charges set forth below.

TERM AND TERMINATION

This Agreement begins on and continues until or until earlier termination as provided below.

Either party may terminate this Agreement for material breach if the breaching party fails to cure such breach within the notice period specified above following written notice. Agency reserves the right to reclaim the animal without refund if Adopter materially neglects care, abuses the animal, or otherwise violates state law or the terms herein.

CONFIDENTIALITY

The parties agree that personal contact information and non-public veterinary or behavior records provided by either party shall be maintained in confidence and used only as necessary to effectuate the care and welfare of the animal, except as required by law or court order. Adopter shall not publish or disseminate confidential records of the Agency or previous owner without prior written consent.

REPRESENTATIONS & WARRANTIES

Agency represents that, to the best of its knowledge, the information provided regarding the animal's health and history is accurate. Adopter represents that Adopter has disclosed all relevant information about their household and ability to care for the animal and will not transfer custody without prior written consent of Agency.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state in which the Adoption Agency is located, without regard to conflict of law principles.

ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties regarding the subject matter hereof and supersedes all prior and contemporaneous agreements, representations, and understandings. Any amendment must be in writing and signed by both parties.

MISCELLANEOUS

If any provision of this Agreement is held invalid, the remaining provisions shall remain in full force and effect. Neither party may assign its rights or obligations under this Agreement without the prior written consent of the other party, except that Agency may assign to a successor organization that assumes Agency's obligations.
