What an Adoption Services Agreement Covers

An Adoption Services Agreement is a written contract that documents the professional relationship between an adoption agency or service provider and prospective adoptive parents. It typically sets out the scope of services (home study, placement, counseling), fees and payment terms, confidentiality obligations, roles and responsibilities during placement, and the process for termination or modification. The agreement clarifies which party is responsible for background checks, medical record collection, and court filing support, and it records consents required for the agency to act on behalf of the child and family.

Why a Clear Agreement Matters for Adoption

A written Adoption Services Agreement reduces uncertainty by defining services, timelines, costs, and legal responsibilities. It helps protect the rights of adoptive and birth parents, documents consent and disclosures, and creates a record for courts and regulators to rely on during placement and finalization.

Clear role assignments in the agreement reduce disputes, speed reviews, and support compliance with court and licensing requirements.

  • Adoption agencies and licensed social workers who coordinate home studies, placement, and counseling services.
  • Prospective adoptive parents who need to document expectations, fees, and the agency’s obligations.
  • Attorneys or guardians ad litem representing parties in placement or court-review steps.
