Confidentiality

Confidential information excludes information that is public through no fault of the recipient or independently developed.

Assumption of Risk, Release and Indemnity

Client acknowledges that motorcycle touring involves inherent risks including serious injury or death. Client voluntarily assumes all such risks. Client hereby releases, waives, and discharges Provider, its agents and employees from liability for any injury, loss or damage arising from participation in the tour, except to the extent caused by Provider's gross negligence or willful misconduct.

Client represents and warrants that Client holds a valid motorcycle license and current insurance covering the Client and any motorcycle ridden by Client during the tour.

Limitation of Liability; Force Majeure

Except for gross negligence or willful misconduct, Provider's total aggregate liability for any claim arising out of or in connection with this Agreement shall not exceed the total fees paid by Client under this Agreement. Provider shall not be liable for delays or failures in performance caused by events beyond its reasonable control, including acts of God, natural disasters, government actions, strikes, or road closures.

Governing Law; Entire Agreement

This Agreement shall be governed by and construed in accordance with the laws of the state or jurisdiction in which Provider is principally located, without regard to conflict of law principles. Any dispute arising out of or relating to this Agreement shall be resolved by binding arbitration or in the courts of that jurisdiction as selected by Provider, subject to mandatory legal protections.

This Agreement, including any attachments or written statements incorporated by reference at the time of booking, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, representations or agreements, whether written or oral. Any modification or waiver must be in writing and signed by both parties.
