Employment Agreement between a Bartender (as an Independent Contractor) and a Business that Supplies Bartenders to Parties and Special Events Agreement made on the ______ day of _____________________________, 20_____, between __________________________________________________ (Name of Business) of _______________________________________________________________________________________________________________________ (street address, city, county, state, zip code), referred to herein as Business, and _________________________________________ (Name of Bartender) of __________________________________________________________________ _________________________________________ (street address, city, county, state, zip code), referred to herein as Bartender. Whereas, Bartender is a professional bartender looking for functions such as private parties and special events where he can practice his craft; and Whereas, Business is in the business of supplying bartenders to functions such as private parties and special events; Now, therefore, in consideration of the matters described above, and of the mutual benefits and obligations set forth in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Business agrees to employ Bartender as an independent contractor beginning ___________________________________ (date) and continuing until termination in accordance with Section 5. Bartender accepts employment with Business on the terms and conditions set forth in this Agreement, and agrees to tend bar at such locations as assigned to him/her by Business. 2. In consideration of all services to be rendered by Bartender for the benefit of Business, Business shall pay Bartender according to the schedule attached to this Agreement as Exhibit A and initialed by both parties. All compensation shall be paid to Bartender without deductions for taxes or other withholding, and Bartender shall be responsible for all taxes as set forth in Paragraph 3 below. 3. Bartender agrees that he/she is not an employee of Business for any purpose whatsoever, including unemployment tax, social security contributions, income tax withholding or workers compensation, whether state or fed
If required by law, such employee shall file a certificate of exemption from all government agencies upon written request, and is also entitled to a tax deduction for his/her expenses incurred in the performance of his duties. The employer shall reimburse the bartender for his/her expenses incurred in the performance of the duties of bartender and for compensation he/she reasonably receives from the business. 4. Upon failure of bartender to obtain a certificate of exemption from all government agencies, the employer shall, within 5 days after receipt of the above documents, provide to the employee copies thereof and pay the employee the value of what he/she is owed by employer. 5. No person other than a bartender may be employed by business, and no person other than a bartender may perform certain services at a location assigned to him/her by business, and no such person shall perform such services for any party or special event. All bartenders of this state have been granted a current, valid bartenders license from the commissioner, and shall not be exempt under subsection 7 of section 7 of the liquor laws of the state to perform such services as defined herein. Bartender agrees he/she shall remain employed by business only until such time as he is not required to file an application for a bartenders license as provided in section 7. Bartender agrees he/she will not attend or attend any party or special event attended by customers or other members of the public from any source or as described in chapter 23, or attend any function at which alcohol is served until he/she has procured a valid bartenders license as provided in section 7 of chapter 23, and will not perform any such services for any non-drinking member of the public and will notify the supervisor, proprietor or manager of the location assigned to him/her at such time as he/she is no longer required to obtain a bartenders license as provided in section 7 of this chapter. Bartender further agrees not to perform any services for any party or special event where such services would cause a violation of chapter 22 when such services are performed pursuant to a business license as provided by the commissioner. Bartender agrees he/she will not be asked or required by business or the supervisor to provide his/her date of birth for business card purposes, and that no one other than bartender will use a business card of the parties or any member of the public except bartender/customers. Bartender agrees to keep accurate and current detailed records of all hours worked and total receipts from each sale or other services for all.
