Whereas, Staging Service is in the business of renting home décor items and accessories for home stagings; and Whereas, Client desires to use the services of Staging Service pursuant to the terms of this Agreement; Now, therefore, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Description of Services A. Beginning on ______________ (date) Staging Service will provide a partial staging package for the Client’s Property, hereinafter called Property. A Partial Staging, for purposes of this Agreement, is defined as service typically involving staging the property with accessories, NOT including furniture -- accessorizing the kitchen, bathrooms, eat in area, and typically the fireplace surround. Staging Service may add furniture at its discretion, however it does not include furniture as part of a Partial Staging Package unless defined and listed as an addendum to this Agreement. 2. Payment & Term Client agrees to pay the full amount of the fee for staging the property o the execution of this Agreement, which includes up to 6 months rental period for the furnishings. The full amount of fees for staging the property must be paid within 12 months of receipt of full amount of service fees, which includes 6 months of rental period. D. Failure to make payment prior to the expiration of the 6 months will cause the full amount of the fee to be unpaid. E. The full amount of fees will become due at the expiration date of the 6 months of rental period, if the full amount of the fee has been paid and is in the client's possession. The client, by signing this agreement, waives his right to be entitled to a reasonable fee for staging of the property on the basis that the client was not given proper notice of this agreement in accordance with the notice provisions of the laws of this state. H. The client fails to fulfill the provisions of this agreement as required by this agreement. I. The client is in default under this agreement, including failure to comply with the limitations that govern the use and the manner in which property will be staged. A failure to comply with a requirement of this agreement, whether caused by the client, may result in the client's forfeiture of any right to a refund or payment of any fees that is due and payable by the client, including fee waivers or refunds. 2.
