Agreement and Release for Working at a Non-Profit Organization as a Volunteer Agreement made on the ____ day of _________________________, 20____, between __________________________________ (Name of Volunteer) of _______________________ ______________________________________________________________________________ _________________________________________ (street address, city, county, state, zip code) , referred to herein as Volunteer , and ________________________________________________ (Name of Non-Profit Organization) located at ________________________________________ ______________________________________________________________________________ _________________________________________ (street address, city, county, state, zip code) , referred to herein as Organization ; Whereas, Organization is a not for profit organization which operates a ranch which houses and cares for horses and other animals with special needs; and Whereas, much of the work of the Organization at said ranch is done by volunteers who believe in the work of Organization and desire to work for Organization as a volunteer; and Whereas, the work of said volunteers involve a wide range of activities from helping take care of the animals to helping with ranch chores; and Whereas, the undersigned Volunteer believes in the work of Organization and desires to work for Organization as a volunteer; and Whereas, the work of Volunteer will involve (e.g., working in and around horses and doing various chores on the ranch operated by Organization ) ; and Whereas, such work in and around said animals and on the ranch premises involve risks and hazards inherent in working on a ranch around horses and other animals; and Whereas, Organization requires its volunteers to execute this agreement and release before working in and around said ranch premises; Now, therefore, in consideration of the matters described above, and of the mutual benefits and obligations set forth in this agreement, the undersigned volunteer agrees as follows: 1. Volunteer, for himself/herself, his/her spouse, legal representatives, heirs and assigns, hereby releases, waives and discharges Organization, its employees, officers, agents, owners and/or assigns (hereinafter jointly and severally referred to as Releasee ) , from all liability to Volunteer, his/her spouse, legal representatives, heirs and assigns (hereinafter jointly and severally referred to as Releasor ) , for any and all loss or damage, and any claim or damages resulting therefrom, on account of injury to Releasor = s person or property, even injury resulting in death of the Releasor, whether caused by the negligence of Releasee or otherwise, while the Releasor is on or around the ranch premises of Releasee or resulting from Releasor’s being on around the ranch premises of Releasee for any reason. 2. Releasor agrees to indemnify the Releasee and hold Releasee harmless from any loss, liability, damage or cost Releasee may incur due to Releasor’s work on or about Releasee’s ranch premises whether caused by the negligence of Releasee or otherwise. Releasor hereby assumes full responsibility for the risk of bodily injury, death or property damage due to working on and around the ranch premises of Releasee or being on said premises for any reason. Releasor expressly agrees that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of _________________________, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. 3. Any dispute under this agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
