Now, having answered the Plaintiffs Complaint, your Defendant, Counter Claimant (hereinafter referred to as the "Defendant"), avers as follows: 1 . That the Defendant is over the age of nineteen ( 19) years and is a bona fide resident citizen of the State of Alabama and has been for more than six (6) months next preceding the filing of this Counterclaim for divorce. Defendant states that the Plaintiff, is over the age of nineteen (19) years and has been a bona fide resident of the State of Alabama for more than six (6) months next preceding the filing of this Counterclaim for divorce. 2. Defendant and Plaintiff were married on FIELD(7), and lived together as husband and wife until approximately FIEL D(8), at which time they separated and have not lived together as husband and wife since said date of separation. 3. That there were FIELD(9) children born of this marriage, namely, FIELD(l0). 4. Defendant states that there is a complete incompatibility of temperament such that the Defendant and Plaintiff can no longer live together. Defendant states that there has been an irretrievable breakdown of the marriage and that further attempts at reconciliation are impractical or futile and not in the best int erests of the parties. 5. Defendant states that the Defendant and Plaintiff have accumulated, during the marriage of the parties, an interest in or title to certain properties including cash, real estate, furniture, furnishings, automobiles, and other pro perty. 6. Defendant states that the Defendant and Plaintiff have incurred certain debts during the marriage of the parties. WHEREFORE, PREMISES CONSIDERED, your Defendant asks that this Court take jurisdiction of this Counterclaim for divorce; that upon a final hearing Your Honor will grant Defendant relief as follows: A. By divorcing the parties each from the other; B. By entering an Order awarding custody of the children and child support to the appropriate party; C. By ordering a fair and equitable division of all property acquired by the parties during the marriage; D.
