EFFECTIVENESS OF POWER OF ATTORNEY:
For some powers, my agent will have the power, subject to the restrictions in this power of attorney, to do or to authorize any act described in this power of attorney. 2. Effective date of power of attorney: this document is effective on the day after it is executed by me or my agent. 3. Duration of power: as long as this power of attorney is valid and continues in force, my agent has all the same powers as I have. This power of attorney is revocable and revocable only in the same manner as a will is. 4. Other terms and conditions: nothing in this power of attorney prevents me from giving or not giving legal advice and any other kind of assistance to my agent or requires my agent to accept or use any property for which I am legally entitled. When my agent becomes mentally or physically incapacitated, or if my agent otherwise proves unable to provide me with adequate care and support, other laws will apply to me, such as the age discrimination in employment act, the Americans with disabilities act of 1990, or any state or local law that provides for similar protections. As used in this general durable power of attorney, “my agent" means my agent as defined in section 2-106 of the revised code of Alabama and any other individual who is acting on my behalf as my agent, provided that my agent does not include my spouse or my child, nor any grandchild of mine who would be my minor child, under any state or local law that would limit the powers and duties of my agent. If my agent is unable or does not wish to take an action described in this power of attorney or is unable or does not wish to provide me with adequate care and support, this power of attorney will terminate on the date that is 90 days after the termination or inability of my agent or 90 days after the power of attorney is no longer effective, whichever occurs first, and no further action will be necessary. The term “good faith" includes reasonable attempts at providing competent care and support for the benefit of the minor child, except to the extent that such efforts are unable to take into account the child's own rights and interests, the preferences, needs and rights of others, or the need for reasonable medical or surgical care. Any power granted by this general durable power of attorney will continue to be effective for as long as my power of attorney remains in force or the minor child is present, unless the power is revoked by me or my agent on at least two occasions, unless I am deceased, or unless
