8.01[5] Example 1: Fairly Typical Clause Dealing with Limitations on UseExample 1 is a fairly typical clause found in old buildings in the Wall Street area of Manhattan dealing with limitations on use. A. Tenant shall use and occupy the Premises for the Permitted Uses, and for no other purpose. B. Tenant hereby represents, warrants and agrees that Tenant's business is not and shall not be photographic multilith or multigraph reproductions or offset printing. Anything contained herein to the contrary notwithstanding, Tenant shall not use the Premises or any part thereof, or permit the Premises or any part thereof to be used, (i) for the business of photographic, multilith or multigraph reproductions or offset printing, (ii) for a retail banking, trust company, depository, guarantee or safe deposit business catering to "off-the- street" clientele in a manner which would materially impact upon the amount of pedestrian traffic to and from the Premises, (iii) as a savings bank, a savings and loan association, or as a loan company, (iv) for the sale of travelers checks or money orders or for the receipt of money for transmission, (v) as a restaurant or bar or for the sale of confectionery, soda, beverages, sandwiches, ice cream or baked goods or for the preparation, dispensing or consumption of food or beverages in any manner whatsoever; provided, however, that Tenant may have luncheons and receptions within the Premises and Tenant may maintain a pantry within the Premises in which no food shall be cooked but which pantry may contain a refrigerator, dishwasher, coffee machines, vending machines, a microwave oven for the warming of food and a dwyer-type unit (so long as none of the foregoing, shall require ventilation or any alteration whatsoever to any of the mechanical system serving the Building), (vi) as a news or cigar stand, (vii) as an employment agency, labor union office, physician's or dentist's office, dance or music studio, school (except for the training of employees of Tenant), (viii) as a barber shop or beauty salon, (ix) for the direct sale, at retail or otherwise, of any goods or products, or (x) as a "retail" stock broker's or dealer's office catering to "off-the-street" clientele in a manner which would materially impact upon the amount of pedestrian traffic to and from the Premises. Nothing in this subsection B shall preclude Tenant from using part of the Premises for photographic, multilith or multigraph reproductions in connection with, either directly or indirectly, its own business and/or activities.
