WHEREAS

WHEREAS, Owner is the lawful owner of the animal described herein and has full authority to surrender all right, title and interest in the animal to Receiving Organization; and

WHEREAS, Receiving Organization is willing to accept custody of the animal and assume sole responsibility for the animal's care, disposition and related decisions upon acceptance; and

WHEREAS, the parties desire to set forth their respective rights and obligations with respect to the surrender, transfer, and post‑surrender care and disposition of the animal.

PAYMENT TERMS

The Owner agrees to pay a nonrefundable surrender fee in the amount of $ payable to Receiving Organization upon execution of this Agreement, unless otherwise agreed in writing.

Late payments shall incur a late fee of for each thirty (30) day period past due. Any payment obligations described in this Agreement survive transfer only to the extent expressly set forth herein.

TERM AND TERMINATION

This Agreement is effective as of and continues until the earlier of placement, adoption, lawful disposition, or .

Either party may terminate this Agreement prior to acceptance by the Receiving Organization by providing written notice to the other party at least days in advance. Upon acceptance by Receiving Organization, termination by Owner does not void transfer of title and custody unless mutually agreed in writing.

CONFIDENTIALITY

Each party shall keep confidential all nonpublic Owner information and records obtained in connection with this Agreement, including medical records and personal contact information, except as required by law or necessary for the care, placement or veterinary treatment of the animal. Receiving Organization may disclose limited information to potential adopters, veterinary providers, and enforcement authorities as reasonably necessary.

REPRESENTATIONS, RELEASE AND INDEMNITY

The Owner represents and warrants that to the Owner's knowledge: (a) the Owner is the sole legal owner of the animal or has the authority to surrender the animal; (b) there are no liens, encumbrances or third‑party claims to the animal; and (c) the Owner has disclosed all known medical conditions, behavioral issues and incidents of biting or aggression.

The Owner hereby releases and forever discharges Receiving Organization, its officers, employees, volunteers and agents from any and all claims, liabilities or causes of action arising from or related to the care, placement, treatment, or disposition of the animal following transfer of custody, except for claims arising from gross negligence or willful misconduct by Receiving Organization.

The Owner agrees to indemnify and hold harmless Receiving Organization from and against claims, damages and expenses (including reasonable attorneys' fees) resulting from any misrepresentation by Owner regarding ownership, medical or behavioral history, or other material facts.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state in which Receiving Organization is located, without regard to conflict of law principles.

ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings and representations, whether written or oral. Any amendment or modification to this Agreement must be in writing and signed by both parties.

OWNER ACKNOWLEDGMENTS

By signing below, Owner affirms that Owner has read and understands this Agreement, that all information provided herein is true and complete to the best of Owner's knowledge, and that Owner voluntarily surrenders the animal to Receiving Organization.
