What the Aquatic Centre Facility Use Agreement Covers

An Aquatic Centre Facility Use Agreement sets the legal and operational terms for reserving and using pool facilities, associated support spaces, and equipment at a public or private aquatic centre. It records who may use the facility, permitted activities, scheduling and access rules, fees and deposit requirements, insurance and indemnity expectations, supervision and lifeguard responsibilities, safety and cleaning protocols, cancellation and termination provisions, and records retention instructions to reduce disputes and support compliance.

Why a Written Agreement Matters for Pool Use

A clear written agreement reduces scheduling conflicts, documents insurance and supervision responsibilities, and sets predictable financial and safety expectations. It creates an auditable record suitable for electronic signing under ESIGN (15 U.S.C. §7001) and state UETA laws while helping facilities limit liability and manage enforcement.

Why a Written Agreement Matters for Pool Use

Who Typically Completes This Agreement

Typical users include facility managers, recreation coordinators, swim coaches, school administrators, and community groups arranging rentals or programs.

  • Municipal Parks & Recreation departments managing public pool scheduling and permits.
  • Private clubs and fitness centers renting lanes, lessons, or event space.
  • Schools, swim teams, and therapy providers booking recurring or one-time sessions.

Ensure the signer is an authorized representative or facility director to avoid authority or enforceability questions.

Common Preparation Mistakes to Avoid

  • Leaving the scope vague — not listing specific pool areas, times, or excluded spaces creates disputes over responsibility.
  • Omitting insurance details or minimum limits — missing proof can delay approval or expose the facility to uncovered claims.
  • Failing to verify signer authority — individuals signing without proper authorization can create enforceability issues.
  • Relying on handwritten amendments without documenting them formally — informal changes complicate compliance and insurance claims.

Penalties and Risks of an Incorrect or Incomplete Agreement

Liability Claims: Injury-related lawsuits.
Insurance Denial: Missing coverage triggers denial.
Permit Violations: Local fines or closures.
Contract Disputes: Claims over ambiguous terms.
Financial Loss: Refunds and lost revenue.
Regulatory Fines: Health code penalties.
