What an Arts Performance Dance Agreement Is

An Arts Performance Dance Agreement is a written contract that sets the terms between a presenter (venue, festival, or promoter) and a dance artist or company for a live performance. It defines date, time, location, performance duration, compensation, technical and hospitality requirements, licensing for choreography and music, cancellation and force majeure, insurance, and rights for photographs or recordings. The agreement clarifies responsibilities for promotion, travel, lodging, and load-in/load-out logistics. Using a clear, signed contract reduces disputes and documents consent to the professional engagement.

Why a Clear Agreement Matters

Using an Arts Performance Dance Agreement protects both parties by documenting payment, technical and hospitality needs, intellectual property permissions, and cancellation terms. A concise, enforceable contract reduces misunderstandings, speeds payments, and creates a clear record for licensing, insurance, and legal compliance.

Why a Clear Agreement Matters

Typical Users and When They Need It

Typical users include dance companies, individual performers, presenters, festivals, producers, and arts administrators negotiating performance engagements.

  • Independent choreographers and solo dancers needing clear payment and rights language for engagements.
  • Venues and presenters defining technical riders, load-in times, and insurance responsibilities.
  • Arts presenters organizing festivals or tours that require standardized contracts across multiple bookings.

The agreement suits both one-off shows and multi-date residencies; adjust clauses to match scope, budget, and venue requirements.

Who Signs and Why

Artistic Director

Negotiates performance terms, approves programming, and ensures the venue meets technical and hospitality requirements. Responsible for contract review, budgeting, scheduling, and confirming insurance and permits. Typically signs on behalf of presenting organization or delegates signature authority.

Dance Contractor

A dancer, choreographer, or company manager who provides services, details rider needs, and confirms availability. Responsible for delivering settled choreography, complying with copyright licenses for music, and ensuring performers are covered by required insurance and travel arrangements.

Core Clauses Every Agreement Should Include

Essential clauses in an Arts Performance Dance Agreement define payment, logistics, rights, and remedies to protect both presenter and artist during the engagement.

Engagement Details

Specify date, call time, performance duration, rehearsal schedule, location, and load-in/load-out windows. Include contact names and location-specific restrictions such as curfew, noise limits, or audience capacity to avoid misunderstandings.

Compensation

Detail fee structure, payment schedule, deposits, per diems, expense reimbursements, and late payment terms. State currency, invoicing instructions, any required W-9 or tax documentation, and consequences for nonpayment.

Technical Rider

Attach a technical rider listing sound, lighting, staging, load-in requirements, stage dimensions, microphones, and technician availability. Clarify who supplies rental gear and costs for any special equipment or crew.

Rights & Recordings

Define permissions for photography, video recording, live streaming, and social media. Specify ownership of choreography and licensing for recorded performances, and whether the presenter may use excerpts for promotion.

Cancellation

Set cancellation rights, notice periods, deposit forfeiture, and force majeure treatment. Include rescheduling options, remedies for breach, and indemnity limits related to canceled or materially altered performances.

Insurance & Liability

Specify required insurance types and limits for venue and artist, proof of coverage deadlines, and indemnification clauses. Clarify worker classification and whether presenter provides medical or workers’ compensation coverage.

Common Preparation Errors to Avoid

  • Vague payment terms that omit deposit amounts, invoice recipients, or currency causing delayed payment and disputes.
  • Incomplete technical riders leading to last-minute equipment rentals, extra charges, and cancellations.
  • Missing signatures or authority to bind when an agent signs without documented delegation, risking enforceability.
  • Failure to require proof of insurance or specify limits, exposing parties to uninsured liability for accidents or damages.

Consequences of Incomplete or Incorrect Agreements

Nonpayment Risk: Late fees, collections, litigation.
Breach Remedies: Damages, injunctions, specific performance.
Tax Reporting: Missing W-9 triggers backup withholding.
IP Infringement: Unauthorized recordings may prompt claims.
Insurance Exposure: Uninsured losses shift to contracting party.
Operational Delay: Technical gaps cause show cancellation.
