What an Assessment Release Agreement Is

An Assessment Release Agreement is a written authorization that lets an individual or entity permit the disclosure and use of assessment results, reports, or related records to specified recipients for a defined purpose. It identifies the assessment, the parties involved, the scope of information disclosed, the authorized recipients, and any limits on use or redisclosure. In the United States such releases are frequently used in education, healthcare, employment screening, and licensing contexts and may be executed electronically where ESIGN and applicable state law allow.

Why a Clear Release Protects All Parties

A properly drafted Assessment Release Agreement documents consent, limits liability, and defines permissible recipients and purposes. Clear language reduces disputes, supports compliance with privacy laws, and speeds administrative workflows when combined with reliable e-signing and secure recordkeeping.

Why a Clear Release Protects All Parties

Organizations and Roles That Commonly Complete This Agreement

Typical users include evaluators, employers, schools, and counsel who need documented permission to share assessment materials.

  • Assessment providers and clinicians who must obtain client consent before sharing test results or reports.
  • Human resources and hiring teams that request assessment records during background screening or placement decisions.
  • Parents, guardians, and adult clients authorizing disclosure to schools, insurers, or third-party reviewers.

Identify the appropriate signer and recipient roles before preparing the release to avoid processing delays or invalid authorizations.

Representative Signer Profiles

Assessment Firm — Senior Evaluator

A licensed evaluator completes the release to authorize report delivery to specific institutions; the evaluator documents scope, retains a copy, and follows applicable privacy rules such as HIPAA when health data are involved.

School District — Special Education Coordinator

A coordinator requests a signed release from a parent or guardian to obtain external testing records for eligibility determinations and ensures the release includes pupil protections under FERPA and any state education privacy rules.

Core Elements to Include in a Professional Release

A complete Assessment Release Agreement contains precise party names, a description of records, authorized recipients, purpose, effective period, and signature details to ensure enforceability and clarity.

Parties

Identify the disclosing party and the individual whose records are covered using full legal names and, where applicable, role or organization to avoid ambiguity and ensure correct attribution.

Description of Records

Describe assessments and related materials specifically (tests, scoring, raw data, interpretive reports), avoiding vague phrases that could permit broader disclosure than intended.

Authorized Recipients

List named recipients and their contact details or roles; include a catch-all only with careful limits to prevent unintended redisclosure.

Purpose and Use

State the precise purpose for disclosure (eligibility determination, treatment planning, hiring decision) and restrict secondary uses unless explicitly permitted.

Effective Period

Specify when the release begins and ends, or a specific expiration date, and note how revocation is handled for future disclosures.

Signature and Authority

Include signature blocks for the authorizing party, date, and if applicable, authority or relationship (parent, guardian, power of attorney).
