RECITALS

WHEREAS, Petitioner asserts that asylum status or asylum designation previously granted to Respondent contains material facts that warrant reconsideration or termination, including but not limited to fraud, material misrepresentation, changed country conditions, or firm resettlement as described below; and

WHEREAS, Respondent has been provided a description of the grounds asserted in this petition and either consents to seek removal of asylum designation or does not oppose adjudication as set forth in this petition; and

WHEREAS, the parties submit this petition to the adjudicative authority to obtain a final determination and order addressing the asylum designation and any ancillary relief;

NOW THEREFORE, in consideration of the foregoing recitals and the agreements and statements herein, Petitioner respectfully petitions for removal of asylum designation and requests that the adjudicative authority grant the relief requested below.

4. LEGAL GROUNDS FOR REMOVAL

Petitioner asserts one or more of the following legal grounds as the basis for removal of asylum designation. Each asserted ground is supported by the facts and evidence submitted with this petition.

(a) Fraud or Material Misrepresentation: Petitioner alleges that material facts in the asylum application or supporting statements were knowingly false or deliberately concealed such that the original grant was procured by fraud or material misrepresentation.

(b) Changed Country Conditions and Firm Resettlement: Petitioner alleges that circumstances relevant to the asylum grant have materially changed or that the Respondent has been firmly resettled in another country or otherwise no longer meets the eligibility criteria.

(c) Conduct Rendering Respondent Ineligible: Petitioner alleges that Respondent engaged in conduct, including but not limited to criminal activity or threats to public safety or national security, that renders Respondent ineligible to retain asylum or related protections.

8. AMENDMENTS, WAIVER, AND COUNTERPARTS

This petition may be amended by written agreement of the parties or by leave of the adjudicative authority. No waiver of any provision of this petition shall be effective unless in writing and signed by the party waiving compliance. This petition may be executed in counterparts, each of which constitutes an original and together constitute one instrument.

9. GOVERNING LAW; ENTIRE AGREEMENT; SEVERABILITY

This petition and any order entered in connection with it shall be governed by the applicable immigration statutes and regulations and, to the extent consistent therewith, the substantive and procedural laws of the jurisdiction in which the adjudication occurs. This document, together with any attached exhibits and written agreements executed contemporaneously, constitutes the entire petition between the parties with respect to the subject matter herein. If any provision of this petition is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
