ATHLETE LIABILITY WAIVER

This Athlete Liability Waiver (the "Waiver") is made and entered into as of , by and between Participant Name: ("Participant") and Organization Name: ("Organization").

RECITALS

WHEREAS, Organization organizes, operates and conducts athletic activities, training sessions, tournaments and related events (collectively, the "Activities"); and

WHEREAS, Participant desires to participate in the Activities offered by Organization and acknowledges that participation involves inherent risks, including but not limited to bodily injury, permanent disability, or death; and

WHEREAS, the parties desire to allocate risk, set forth Participant's obligations, and provide Organization with express waivers and indemnities as a condition to participation.

NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

1. DEFINITIONS

"Activities" means all athletic training, practices, competitions, camps, travel, and related programs provided, arranged or supervised by Organization. "Claims" means any claims, demands, causes of action, liabilities, losses, damages, costs or expenses, including attorneys' fees and court costs.

2. ASSUMPTION OF RISK

Participant acknowledges and agrees that participation in the Activities involves known and unknown risks, hazards and dangers which may result in serious bodily injury, permanent disability, or death. Participant freely and voluntarily elects to participate and expressly assumes all risk of injury or harm arising out of or related to participation in the Activities, whether caused by the negligence of Organization or otherwise.

3. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by law, Participant hereby releases, waives, discharges and covenants not to sue Organization, its officers, directors, employees, agents, volunteers, coaches, sponsors and affiliates (collectively, "Released Parties") from any and all Claims arising out of or related to Participant's participation in the Activities, whether arising from the negligence of Released Parties or otherwise, including Claims for personal injury, property damage, wrongful death, or any other loss.

4. INDEMNIFICATION

Participant agrees to indemnify, defend and hold harmless the Released Parties from and against any and all Claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys' fees and court costs) arising out of or connected with Participant's negligence, intentional misconduct, breach of this Waiver, or violation of applicable rules while participating in the Activities.

5. MEDICAL AUTHORIZATION

Participant authorizes Organization to obtain emergency medical treatment for Participant in the event of injury and to share medical or personal information as reasonably required to obtain such treatment. Participant agrees to be responsible for all costs of medical treatment and transportation.

6. REPRESENTATIONS AND WARRANTIES

Participant represents and warrants that Participant is physically fit and capable of participating in the Activities, has no medical condition that would preclude safe participation, and will comply with all instructions, rules and safety protocols established by Organization.

7. INSURANCE

Participant acknowledges that Organization does not provide health or accident insurance for Participant. Participant is encouraged to maintain personal medical and accident insurance coverage. Organization's acceptance of this Waiver shall not be construed as admission of any liability or as a promise of or substitute for insurance.

8. MINORS

If Participant is under eighteen (18) years of age, this Waiver must be executed by Participant's parent or legal guardian. The undersigned parent or guardian hereby consents to Participant's participation, acknowledges the risks, and agrees to the terms of this Waiver on behalf of Participant and the parent's or guardian's heirs, assigns and next of kin.

9. MEDIA RELEASE

Participant grants Organization the right to take, use, reproduce and distribute photographs, video, and audio recordings of Participant taken in connection with the Activities for promotional, educational, or other lawful purposes without compensation to Participant, unless Participant expressly opts out in writing delivered to Organization prior to participation.

10. NOTICES

All notices required or permitted under this Waiver shall be given in writing and delivered personally or sent by certified mail, return receipt requested, to the addresses provided below.

11. AMENDMENTS; WAIVER; COUNTERPARTS

This Waiver may be amended only by a written instrument signed by both parties. No failure or delay by either party in exercising any right shall operate as a waiver of that right. This Waiver may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument.

12. GOVERNING LAW; SEVERABILITY; ENTIRE AGREEMENT

This Waiver shall be governed by and construed in accordance with the laws of the state governing Organization's principal place of business without regard to conflict of laws principles. If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements and understandings.

REPRESENTATION OF UNDERSTANDING

Participant acknowledges that Participant has read this Waiver, fully understands its terms, and signs it voluntarily and of Participant's own free will. Participant understands that by signing this Waiver, Participant is giving up substantial legal rights, including the right to sue the Released Parties.
