AUTOMOTIVE SERVICE AGREEMENT

RECITALS

WHEREAS, Service Provider operates an automotive repair and maintenance business and is duly qualified to perform mechanical, electrical, and bodywork services; and

SCOPE OF WORK

ESTIMATE AND PAYMENT TERMS

Late Payment: Unpaid amounts shall accrue a late fee of (or a minimum late charge of $ ). Customer agrees to pay collection costs and reasonable attorney fees for recovery of unpaid charges.

PARTS, TAXES & DISPOSITION

Parts: Customer authorizes Service Provider to order parts as required. Replaced parts shall be retained by Service Provider for inspection for a period of thirty (30) days following completion unless Customer requests return of parts in writing.

Sales Tax and Environmental Fees: Applicable sales tax, hazardous waste fees, and disposal charges are the responsibility of Customer and will be added to final invoice.

WARRANTY ON LABOR

Service Provider warrants labor performed under this Agreement for a period of days from the date of completion, limited to repair or rework of defective workmanship. This warranty does not extend to parts, tires, batteries, or components subject to manufacturer warranty, nor to failures caused by misuse, collision, lack of maintenance, or subsequent repairs by others.

CONFIDENTIALITY

LIMITATION OF LIABILITY & INDEMNITY

Except for liability arising from gross negligence or willful misconduct, neither party shall be liable to the other for incidental, consequential, punitive, or special damages arising out of this Agreement. Customer shall indemnify and hold Service Provider harmless from claims arising from Customer-supplied parts, unauthorized uses, or false representations regarding the vehicle.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to principles of conflicts of law.

ENTIRE AGREEMENT
