What a Background Criminal Check Is and When it Applies

A Background Criminal Check is a formal request to obtain a person’s criminal history records from public and restricted databases, court dockets, and third-party screening vendors. Employers, landlords, licensing boards, and volunteer organizations commonly use it to assess risk and fitness for a role or tenancy. The report may include arrests, convictions, dismissals, and disposition details depending on jurisdiction and source. Results are governed by federal and state law and by consumer-reporting rules when carried out by a consumer reporting agency.

Why a Professional Background Criminal Check Matters

A properly prepared Background Criminal Check protects organizations by improving hiring and placement decisions while reducing legal exposure under consumer protection laws.

  • Failing to obtain informed, documented consent that explains the use and sharing of consumer-report information as required.
  • Not recording the decision-making process and adverse-action notices when reports influence hiring or housing outcomes.

FCRA Liability: Civil damages, statutory penalties, and attorney fees
State Penalties: Fines or administrative actions under state consumer laws
