RECITALS

WHEREAS, Principal named above is charged with the offense(s) described and a bond in the amount set forth above has been ordered by the Court; and

WHEREAS, Surety has agreed to post or procure a bond to secure Principal’s appearance and to satisfy the obligations imposed by the bond; and

WHEREAS, the parties desire to set forth their mutual acknowledgements and undertakings with respect to the bail bond and associated obligations.

NOW, THEREFORE, in consideration of the posting of the bail bond and the mutual covenants herein contained, the parties agree as follows:

1. ACKNOWLEDGEMENT AND UNDERTAKING

1.2 Surety undertakes to ensure Principal’s appearance at all required hearings and proceedings in the above-captioned matter, and to surrender Principal to the Court immediately upon lawful demand.

2. CONDITIONS OF RELEASE

2.1 Principal agrees to comply with all conditions of release imposed by the Court and to notify Surety promptly of any change in address, employment, or contact information.

2.2 If Principal violates any condition of release or fails to appear as ordered, Surety shall take all reasonable measures to secure Principal’s appearance, including but not limited to personal notice, engaging a bail enforcement agent, or surrendering Principal to the Court. Surety acknowledges that failure to take such measures may result in forfeiture of the bond.

3. FORFEITURE, JUDGMENT, AND REMEDIES

3.1 In the event the Court makes a determination of forfeiture, Surety acknowledges liability for the full penal sum of the bond, together with accrued costs, interest, and any sums due to effectuate the bond’s enforcement.

3.2 The Court and/or the State shall have all remedies available at law or in equity to recover sums due, including entry of judgment against Surety and any other person or entity that executed the bond or provided collateral.

4. SURRENDER AND EXONERATION

4.1 Upon final exoneration of the bond by the Court, any collateral held by Surety in satisfaction of the bond shall be returned in accordance with lawful procedures, less lawful deductions. Exoneration occurs only upon entry of an order by the Court releasing Surety from further liability.

5. REPRESENTATIONS AND WARRANTIES

5.1 Surety represents and warrants that it has full authority to execute this Acknowledgement, that information provided to the Court in connection with the bond is true and complete, and that no material fact has been omitted which would affect the Court’s decision to accept the bond.

5.2 Principal represents that the information provided herein is true and that Principal understands the obligations and consequences set forth in this Acknowledgement.

6. NOTICES

Notices given pursuant to this Agreement shall be in writing and delivered to the addresses set forth above or to such other address as a party may designate by written notice. Notice shall be effective upon receipt.

7. COVENANTS

7.1 Surety covenants to maintain communication with the Court and with Principal, to cooperate with lawful requests by the Court, and to provide any requested documentation relating to the bond or to collateral.

7.2 Principal covenants to obey all lawful orders of the Court and to notify Surety prior to any anticipated failure to appear.

8. GOVERNING LAW

9. ENTIRE AGREEMENT; SEVERABILITY

9.1 This Acknowledgement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements and understandings, whether oral or written.
