What a Bar Top Agreement Covers

A Bar Top Agreement is a written contract that sets the terms between a property owner (or venue operator) and a fabricator, installer, or supplier for the design, fabrication, delivery, and installation of a bar top. Typical provisions define scope of work, materials and finish, measurements and tolerances, site access, payment schedule, responsibilities for permits or inspections, warranty terms, and remedies for defects or delays. The agreement clarifies who is responsible for templates, change orders, damage during installation, and final acceptance criteria to avoid disputes during fabrication and handover.

Step-by-step: How to complete the agreement

Follow these core steps to prepare, review, and finalize a Bar Top Agreement with minimal rework and clear handoff to fabrication and installation teams.

  • 01
Gather specs: Collect drawings, measurements, finish samples, and permit requirements.
  • 02
Draft scope: Document materials, tolerances, delivery and installation tasks.
  • 03
Review terms: Confirm payment schedule, warranties, and access windows with stakeholders.
  • 04
Sign & schedule: Obtain signatures and set fabrication and installation dates.

Who typically prepares and signs a Bar Top Agreement

The agreement is used by parties directly involved in specifying, fabricating, installing, and owning the bar top.

  • Bar owners or venue managers responsible for commissioning fabrication and approving final acceptance criteria.
  • Fabricators, millworkers, or cabinetry contractors who supply and install the bar top and guarantee materials and workmanship.
  • Designers, architects, or general contractors who coordinate measurements, access, and inter-trade sequencing.

Each signer should have authority to bind their organization and confirm site access, payment obligations, and schedule commitments.

Essential clauses to include in a professional Bar Top Agreement

A comprehensive agreement reduces scope misunderstandings and preserves remedies; include precise clauses that control performance, cost, timing, and quality.

Scope of Work

Define exact deliverables: materials, thickness, edge profile, finish, cutouts, and acceptable tolerances so fabrication aligns with expectations and permits.

Materials and Finish

Specify vendor brand, grade, color code, finish procedure, and acceptance sampling to avoid later disputes about substitute materials.

Measurements & Tolerances

State measurement responsibility, acceptable variance in millimeters or inches, and rework or replacement obligations for out-of-tolerance items.

Pricing & Payment

List deposit amount, milestone payments, retainage, payment methods, late fee rates, and conditions for withholding payment.

Installation & Access

Specify installation dates, required site access, trade coordination, permit ownership, and cleanup responsibilities to minimize schedule risk.

Warranty & Remedies

Define warranty duration, scope, remedy procedures, exclusions (e.g., normal wear), and dispute resolution or limitation of liability clauses.

Key data elements to include for clarity and recordkeeping

Authorized signatures: Names and titles
Effective and delivery dates: MM/DD/YYYY
Material specifications: Make, model, code
Payment schedule: Deposit and milestones
Site access details: Hours and contact
Warranty period: Length and scope

Typical e-sign workflow settings for the agreement

Configure the online signing workflow to capture intent, attribution, and an auditable record that meets ESIGN and UETA tests.

Field Configuration
Signature Method eSignature required; allow guest signing
Authentication Email plus optional SMS code
Conditional Fields Show change-order fields only if checkbox checked
Reminder Cadence Automatic reminders every 3 days

Digital signing and file compatibility

Choose a platform that preserves a tamper-evident copy, captures an audit trail, and supports common file formats.

  • File formats: PDF and DOCX
  • Integrations: NetSuite, Google Workspace, Microsoft 365
  • Security: TLS and AES-256 encryption

Verify the platform supports conditional fields, mobile signing, and audit reports that show timestamps, IPs, and signer attribution for dispute defense.

Where the agreement goes and how it moves

A clear routing sequence ensures the right parties approve specifications before fabrication begins.

  • Owner uploads: Upload drawings and specs to the signing platform.
  • Place fields: Add signature, initial, and date fields for each party.
  • Send to fabricator: Fabricator reviews, signs, and confirms lead time.
  • Store copy: Save executed PDF and audit trail in project repository.

Typical timing and deadline items to track

Track dates that trigger fabrication, installation, payments, and final acceptance to avoid schedule or payment disputes.

Pre-fabrication sign-off:

Signed agreement required before fabrication begins; delays can shift production lead times.

Deposit due date:

Due on or before the effective date to reserve materials and production capacity.

Fabrication lead time:

Specify the expected number of production weeks or days.

Installation notice:

Owner must provide site access notice a minimum number of days before install.

Final payment deadline:

Due upon final acceptance or within a stated number of days after completion.

Common mistakes to avoid when preparing the agreement

  • Vague scope descriptions that allow substituted materials or undefined workmanship standards and lead to disputes.
  • Missing site-measurement responsibilities so neither party accepts accountability for fabrication mismatches.
  • Unclear payment triggers that create holdbacks and disagreement over release of final payments.
  • No access or permit obligations, causing installation delays and added costs for rework or scheduling.

Primary risks and contractual consequences

Late delivery: Schedule delay
Incorrect measurements: Rework or replacement costs
Payment disputes: Liens or withheld funds
Warranty void: Improper maintenance or alteration
Permit noncompliance: Fines or installation stoppage
Missing signatures: Enforceability risk
