What a Battery NEM Agreement Is and Why It Matters

A Battery NEM Agreement documents the terms under which an energy storage system (battery) participates in a utility's Net Energy Metering (NEM) or export-compensation program. It typically covers ownership, system description, interconnection, metering and export compensation, data access, and liability allocation. The agreement clarifies who may discharge or export stored energy, how exported kWh are measured and credited, and what operational or safety rules apply. For distributed generation owners, installers, and utilities, this contract reduces operational uncertainty and defines financial and technical responsibilities.

Purpose and Core Advantages of a Battery NEM Agreement

A clear Battery NEM Agreement protects parties by assigning responsibilities for interconnection, metering, export compensation, data sharing, maintenance, and safety. It reduces disputes over credits, clarifies revenue flows from exported energy, and documents required certifications and inspections so projects can move from commissioning to steady operation with predictable treatment under the utility tariff.

Purpose and Core Advantages of a Battery NEM Agreement

Who Typically Completes a Battery NEM Agreement

The agreement is completed by the system owner or developer, often with assistance from the installer and utility account manager.

  • Residential system owners or household project developers managing on-site batteries and solar-plus-storage for a single-meter service.
  • Commercial building owners, C&I developers, or microgrid operators coordinating export compensation and aggregated metering arrangements.
  • Utilities, third-party program administrators, and aggregators that require operational controls, telemetry, and contractual access to performance data.

Parties should verify signatory authority, interconnection requirements, and any program-specific forms required by the enrolling utility before signing.

Primary Signers and Their Responsibilities

Owner / Account Holder

Typically the retail customer on the utility account; responsible for consenting to interconnection, permitting access to meters and batteries, and accepting billing credits or charges per the agreement.

Installer / Developer

Installs and commissions the battery system, certifies equipment and safety compliance, assists with the interconnection application, and may provide ongoing maintenance or monitoring under the contract.

Essential Fields Required in the Agreement

Owner Name: Full legal name
System Address: Street, city, state, ZIP
Utility Account: Account number
System Specs: Capacity (kW/kWh)
Metering Type: Net/interval/export
Effective Date: MM/DD/YYYY

Core Clauses to Include in a Professional Battery NEM Agreement

A complete agreement contains operational, financial, safety, and administrative provisions that assign risk and define compensation.

Parties & Recitals

Identify the owner, installer, utility, and any aggregator; summarize the project and program under which export credits will be issued, including tariff or program name and reference to the interconnection application.

System Description

Specify battery make/model, nameplate kW and usable kWh, inverter details, telemetry requirements, and any site constraints that affect operation or dispatch.

Metering and Compensation

State whether export is measured at the retail meter or a separate meter, how credits are calculated, timing of settlement, and any cap on exported energy or credits.

Interconnection and Safety

Allocate responsibility for interconnection application, permitting, protective relays, anti-islanding, and compliance with utility technical requirements and inspection protocol.

Data Access and Privacy

Define telemetry and meter data required, who may access it, retention, and any HIPAA or data-protection obligations when health-related or third-party data are present.

Term and Assignment

Set the agreement term, conditions for transfer on property sale, early termination mechanics, and remedies for breach or persistent noncompliance.

Step-by-Step: How to Complete a Battery NEM Agreement

Follow these sequential actions to prepare, review, and finalize the agreement with the utility and any third-party aggregator.

  • 01
Gather Documents: Collect permits, equipment specs, and utility account details.
  • 02
Complete Form: Enter owner, system, metering, and compensation fields.
  • 03
Review Terms: Confirm interconnection and data-access provisions with utility.
  • 04
Sign & Submit: Obtain authorized signatures and deliver to the utility or program administrator.

Customizing and Submitting the Agreement Online

Digital completion lets you attach supporting documents, route for approval, and preserve an audit trail for utility reviews and future disputes.

Field Configuration
Owner Details Use exact name and account number
System Attachment Upload datasheets and permit scans
Signature Order Specify signer sequence for owner, installer, utility
Notifications Enable email/SMS for status updates

Digital Signing and eSubmission Considerations

Use an eSignature platform that supports audit trails, PDF output, and optional stronger signer authentication for utility or regulatory requirements.

  • File Formats: PDF and DOCX supported
  • Authentication: Email, SMS, or advanced methods
  • Integrations: CRM and cloud storage

Confirm the utility accepts electronically signed agreements and whether a notarization or witnessed signature is required before submission.

Where to Send the Completed Battery NEM Agreement

After signing, route the agreement and supporting documents to the correct utility contact and retain a signed copy for records.

  • Utility Interconnection Desk: Primary recipient for application and agreement
  • Program Administrator: If enrollment is through a separate aggregator
  • Installer / Developer: Retains copy for commissioning and maintenance
  • Local Authority: Permit office for inspection records

Typical Timelines and Processing Expectations

Expect multiple review stages. Timelines vary by utility and interconnection queue; plan for administrative review, technical review, inspection, and final authorization.

Interconnection Application:

Utility review often 2–8 weeks depending on backlog

Technical Evaluation:

May require studies; 2–12 weeks for complex sites

Inspection and Commissioning:

Schedule local inspection; typical window 1–4 weeks

Meter Exchange:

If needed, utility installs new meter in 1–6 weeks

Final Authorization:

Permission to operate issued after all approvals

Key Milestones from Application to Operation

A sequential checklist highlights the principal decision and action points during enrollment and commissioning.

01

Submit Application

Send agreement, equipment specs, and permits to utility

02

Technical Review

Utility confirms safety, grid impact, and metering needs

03

Install & Inspect

Complete installation and pass the local inspection

04

Authorize Operation

Utility issues final permission and begins crediting

Common Mistakes to Avoid When Preparing This Agreement

  • Using an incorrect utility account number or mismatched owner name that delays processing and may trigger requests for corrected documents.
  • Failing to attach required equipment datasheets, permit approvals, or interconnection application forms required by the utility.
  • Omitting telemetry or data-access permissions needed by the utility or aggregator for program participation and performance verification.
  • Assuming export compensation applies automatically without confirming tariff eligibility and any program caps or sunset clauses.

Penalties and Operational Risks from an Incorrect Agreement

Loss of Credits: Forfeiture of export compensation
Interconnection Delay: Project commissioning postponed
Safety Liability: Potential fines or corrective orders
Contract Dispute: Costly remediation and legal expense
Tax Exposure: Misreported income or credits
Data Breach Risk: Unauthorized telemetry disclosure

Supporting Documents to Attach and Download Formats

Attach key supporting documents in standard formats to avoid processing delays and preserve a clear record for utility review or audits.

Equipment Datasheets

Include manufacturer spec sheets in PDF to confirm nameplate kW/kWh and inverter certifications

Permits and Inspections

Upload local permits and passing inspection reports as PDF or image files
