BIKE RENTAL AGREEMENT

This Bike Rental Agreement (the Agreement) is entered into between Lessor: , with address , and Renter: , with address .

WHEREAS

WHEREAS, Lessor owns or controls the bicycle and related accessories described in this Agreement, and desires to rent the bicycle to Renter on the terms set forth herein; and

WHEREAS, Renter desires to rent and operate the bicycle for lawful recreational or commuting purposes and agrees to assume the risks and responsibilities described in this Agreement.

EQUIPMENT DESCRIPTION

SCOPE OF RENTAL

Lessor rents to Renter, and Renter accepts from Lessor, the bicycle and the accessories described above for the purpose of personal transportation or recreation in accordance with the terms and conditions contained in this Agreement. Renter shall use the bicycle only for lawful purposes and shall not permit any other person to operate the bicycle without Lessor's prior written consent.

Early termination by either party requires written notice to the other party at least days prior to the intended termination date. Lessor may terminate immediately for material breach, abandonment, or operation in a negligent or illegal manner.

USE, MAINTENANCE AND DAMAGE

Renter shall operate and maintain the bicycle in a careful and lawful manner, perform routine checks, and return the bicycle in substantially the same condition as delivered, ordinary wear and tear excepted. Renter shall be responsible for all damage, theft, or loss occurring during the rental term. Repairs in excess of $ require Lessor's approval; unapproved repairs are at Renter's risk.

Replacement Cost: If the bicycle is not returnable, Renter agrees to pay the replacement cost of $ plus any administrative fees.

ASSUMPTION OF RISK, WAIVER AND INDEMNIFICATION

Renter acknowledges that bicycling involves inherent risks including but not limited to collisions, falls, and road hazards. Renter accepts and assumes all risk of injury, death, or damage to property arising from use of the bicycle. Renter releases Lessor, its agents and employees from liability for personal injury, death, or property damage except to the extent caused by Lessor's gross negligence or willful misconduct.

Renter agrees to defend, indemnify, and hold harmless Lessor from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of Renter's use, possession, or operation of the bicycle.

INSURANCE

CONFIDENTIALITY
