The recorder and each and every witness to this final release, this release and the receipt attached hereto, hereby acknowledge that all or any part of this release is true, correct and correct to the best of my knowledge and belief. <|endowment|>new york consolidated laws, penal law — pen § unauthorized use of emergency radio notwithstanding any regulation or order made by the commissioner or the commissioner's authorized representative in accordance with section fifteen-a of this chapter, any person who willfully and unlawfully uses a wireless telephone to transmit or receive communications or messages, using any emergency radio frequency, when the communications or messages are prohibited by the provisions hereof or are not authorized by this paragraph shall be fined 300. 1. Any person who willfully and unlawfully makes any telephone call, which causes the activation or maintenance of any emergency telephone system in this state, or to which a law enforcement agency has given a false code in order to place the telephone in an emergency or to facilitate any action or to prevent any action, other than the arrest thereof, that the caller does not believe or has reason to believe to be necessary for the safety of the person making the telephone call or another person present. A violation of this paragraph shall be a class a misdemeanor. 2. Notwithstanding any other provision of law, no peace enforcement agency shall give an operator or caller the code “111" during any emergency while the emergency telephone system is activated. A violation of this paragraph shall be a class a misdemeanor. 3. Notwithstanding any other provision of law, no person, firm or corporation shall knowingly maintain, operate or use any electronic communication service which, to the knowledge of the provider, is used to make or facilitate any unlawful use of a wireless telephone. A violation of this paragraph shall be a class a misdemeanor. 4. Notwithstanding any other provision of this section, no person shall willfully cause interference to other persons lawfully using an emergency telephone system. A violation of this paragraph shall be a class a misdemeanor. 5. In addition to any penalty imposed in paragraphs one, two and three of this section, any person who knowingly: (i) fails to report, when the information reported so requested and is required to be reported under this article, to the proper law enforcement agency, which will be provided the information, and (ii) uses or operates the wireless telephone during an emergency when prohibited by section fifteen-a of this chapter shall be fined.
