What the Biometric Data Consent Form Is and When It’s Used

A Biometric Data Consent Form documents an individual’s informed permission for the collection, use, storage, and sharing of biometric identifiers (for example, fingerprints, facial scans, iris scans, voiceprints). Organizations use this form when biometrics are captured for authentication, access control, timekeeping, patient identification, or fraud prevention. The form should describe purpose, retention, security measures, third-party disclosures, and revocation procedures. When executed electronically the form must meet ESIGN and UETA standards and, when applicable, state biometric privacy statutes such as Illinois’s BIPA.

Why a Clear Consent Form Matters for Biometric Data

A well-drafted Biometric Data Consent Form documents informed consent, reduces legal risk under state biometric statutes and federal privacy frameworks, and creates an auditable record of the subject’s choices and the organization’s promises about retention and security.

Why a Clear Consent Form Matters for Biometric Data

Who Typically Completes a Biometric Data Consent Form

Organizations and individuals complete the form when biometric identifiers will be collected, processed, or stored.

  • Employers and HR teams handling timekeeping, access control, and identity verification for staff.
  • Healthcare providers and clinics capturing biometrics for patient ID, treatment matching, or device access.
  • Financial services and fintech firms using biometrics for authentication and fraud reduction.

Responsible parties should ensure the signer understands scope, retention, third-party sharing, and how to revoke consent.

Core Sections Every Professional Form Should Include

A complete Biometric Data Consent Form combines clear disclosures, specific purpose limitations, retention rules, and mechanisms for revocation and dispute resolution to satisfy legal and practical requirements.

Disclosure

Plain-language explanation of what biometric data will be collected, how it will be used, and who will have access to it, enabling informed consent.

Purpose Limitation

Explicit description of authorized uses (authentication, timekeeping, identification) and an assurance data will not be repurposed without new consent.

Retention and Deletion

Clear retention schedule and deletion procedure, including events that trigger deletion and any archival obligations tied to regulatory retention periods.

Third-Party Sharing

List of categories of recipients (cloud providers, analytics vendors, law enforcement) and the legal basis for any disclosures.

Security Measures

Summary of technical and organizational safeguards (encryption, access controls, logging) used to protect biometric data from unauthorized access.

Revocation & Remedies

Instructions for withdrawing consent, implications for access or services, and information about dispute resolution or legal remedies.

Step-by-Step: Completing the Consent Form

Follow a consistent sequence to ensure informed consent and a defensible audit trail when collecting biometric data.

  • 01
Read Disclosures: Carefully review purpose, retention, and sharing sections before consenting.
  • 02
Confirm Identity: Provide full legal name and verify ID if required by policy.
  • 03
Specify Scope: Select biometric type and permitted uses to narrow consent.
  • 04
Sign and Date: Execute signature method and record MM/DD/YYYY date for the record.

How Electronic Execution and Recordkeeping Works

Electronic consent follows a standard workflow that captures signer identity, intent, and an immutable audit trail consistent with ESIGN and UETA.

  • Upload Document: Sender uploads form to the e-signature platform and places fields.
  • Add Signers: Enter signer contact details and assign required fields.
  • Authentication: Signer authenticates via email, SMS code, or stronger methods.
  • Signature Capture: Platform timestamps, stores audit trail, and provides signed copy.

Recommended Digital Workflow Settings

Configure the signing workflow to match the legal and operational requirements for biometric consent collection.

Field Configuration
Authentication Method Email + SMS code or two-factor for higher assurance
Consent Disclosure Require affirmative checkbox with full disclosure text
Retention Setting Set document retention to meet regulatory period
Revocation Method Provide email or web form instructions for withdrawal

Technical and Integration Considerations for eExecution

Ensure the platform supports required file types, authentication, and audit logging before collecting biometric consent.

  • File Formats: PDF and DOCX supported
  • Authentication: Email, SMS, or stronger 2FA
  • Integrations: Salesforce, Microsoft 365, NetSuite

Security and Compliance Controls to Document

Encryption in transit: TLS 1.2/1.3
Encryption at rest: AES-256
Audit Trail: Complete signing log
HIPAA BAA: Available when required
SOC 2: SOC 2 Type II
Two-factor auth: Optional strong signer auth

Common Preparation Errors to Avoid

  • Using vague purpose language that permits future repurposing and weakens consent defensibility.
  • Failing to state a retention period or deletion procedure, which can create regulatory noncompliance risk.
  • Mismatching signer name and identity documentation, resulting in attribution disputes and operational delays.
  • Relying on weak authentication for high-risk biometric captures without additional verification or logging.

Potential Legal and Financial Consequences of Inadequate Consent

Statutory Fines: Civil penalties under state biometric laws
Private Lawsuits: Private right of action in some states
Regulatory Enforcement: Agency investigations and orders
Contractual Liability: Breach claims under vendor contracts
Data Breach Costs: Notification and remediation expenses
Operational Impact: Service suspension or access limitations

Practical Examples of How the Form Is Used

Two common scenarios highlight the form’s language and operational considerations across sectors.

Healthcare Provider

A clinic collects facial recognition for patient check-in

  • Limited to patient matching only
  • The form states retention for six years, requires a HIPAA BAA with vendor, and explains how patients may withdraw consent and the clinical consequences of withdrawal.

Property Management

A building operator uses fingerprints for tenant access control

  • Enrollment for building access only
  • The consent limits use to access control, discloses third-party cloud storage, specifies a two-year retention, and provides a revocation request process.
