What the Board of Realtors Listing Agreement Is

A Board of Realtors Listing Agreement is a written contract that authorizes a real estate brokerage to market and attempt to sell a property on behalf of the seller. It defines listing price, term, broker compensation, MLS authorization, seller representations, and permitted marketing activities. The agreement describes duties and agency relationships between seller and broker and can include addenda for disclosures, contingencies, or special provisions. Electronic execution is generally permitted under federal ESIGN law (15 U.S.C. ch. 96) and state UETA statutes where applicable.

Why a Proper Listing Agreement Matters

A clear, complete listing agreement establishes commission terms, marketing scope, and the broker’s authority to list on MLS, reducing disputes and accelerating transactions while documenting seller consent and key dates.

Why a Proper Listing Agreement Matters

Who Typically Completes This Agreement

The listing agreement is completed at the start of a listing and involves seller and listing broker representatives.

  • Sellers — Homeowners or legal owners who must confirm identity, title status, and disclosures.
  • Listing agents/brokers — Prepare the contract, set price guidance, and complete MLS authorization fields.
  • Brokerage transaction coordinators — Review documents for compliance, collect supporting forms, and manage signatures.

Each participant must sign and date; agents should retain a copy in brokerage files and upload required data to MLS as specified by local rules.

Core Elements to Include in a Professional Listing Agreement

A thorough listing agreement organizes obligations, compensation, timelines, disclosures, and MLS permissions so the seller and brokerage know expectations and legal responsibilities.

Exclusive Right

Specifies whether the broker has exclusive authority to market and earn commission if the property sells within the term, regardless of procuring party.

Listing Term

Defines the start and expiration dates of the listing and how extensions or renewals are handled to avoid automatic renewals.

Listing Price

Records the initial asking price and any agreed procedure for price adjustments or seller approval for reductions.

Commission

States compensation structure, percentage or flat fee, payment timing, and how referral or cooperating broker splits are allocated.

MLS Authorization

Authorizes broker to enter listing into MLS and specifies marketing channels, photographs, lockbox use, and showings.

Seller Representations

Seller warranties and required disclosures about property condition, hazards, title defects, liens, and other material facts.

Common Errors to Avoid When Preparing a Listing

  • Not recording electronic consent or using weak authentication risks future enforceability challenges.

Potential Consequences of Incorrect or Incomplete Agreements

Commission Disputes: May lead to arbitration
MLS Fines: Sanctions for noncompliance
Contract Voidance: Ambiguity can void clauses
Delayed Closing: Incorrect info can push closing
Tax Exposure: Reporting errors trigger penalties
Consumer Claims: Undisclosed defects risk lawsuits
