Insurance, Liability and Indemnity

Renter shall maintain, at renter's expense, liability insurance covering the vessel with minimum limits of and shall provide proof of insurance prior to departure. Owner may, at owner’s option, require additional coverage.

Renter accepts sole responsibility for all personal injury, property damage, salvage, towing, and related costs arising from renter's use of the vessel, whether caused by negligence or otherwise, and agrees to indemnify and hold owner harmless to the fullest extent permitted by law.

Operations, Safety and Restrictions

Default, Remedies and Termination

Owner may terminate this Agreement and retake possession of the vessel upon renter's breach, including but not limited to failure to pay, unsafe operation, or violation of law. Renter shall be liable for all losses, costs, attorney's fees, and lost rental revenue resulting from renter’s breach.

In the event of late return, renter shall pay a late return fee of per hour until vessel is returned and secured.

Governing Law; Entire Agreement

This Agreement shall be governed by and construed in accordance with the laws of the state in which the vessel is principally berthed as listed in this Agreement. This Agreement constitutes the entire agreement between the parties concerning the subject matter and supersedes all prior agreements and understandings, whether written or oral.
